Can you use an iphone4 without data plan on AT&T?

So I am currently under AT&T family plan with only unlimited txting and no data plan.
as of now, I have Ipod touch4 and just dumbphone.

But now that Iphone4S is out, used iphone4 price is <$300 so I am wondering if I can use it as my phone without data plan.

The main reason why I want iPhone4 over ipod touch4+dumbphone is

1. portability
2. better camera
3. faster processor

I have previously put in my regular SIM card to iPhone 3GS and got caught so I had to come back to dumbphone and sell my iphone.
but now I know about JB and such I wanna know if there is any app or something
that can let me just use it without data plan.

any SDer know of this??

ATT will automatically add a $15/mo data plan to your account and won't let you remove it anytime you stick your sim in a smart phone.

You have to be careful as used phones you might buy can actually be stolen.

Also the iphone 4s uses a micro sim.

i have iphone 3g with att family plan. i still same bill all the time..

No, AT&T will detect your phone and charge you. There is no way to get around this that i know of even with jailbreaking

My GF uses a iPhone 3G with no data plan on her family's plan. She has gotten caught before but she calls them to say she put her sim in her friends phone temporarily. You need to have a standard phone otherwise they won't switch it back. She has been doing this for over a year and only got caught 2 to 3 times. It seems that she gets nailed when she goes onto her family's microcell which is pretty rare. I don't know if they have changed the hardware on the 4G to prevent this or make it more difficult, but I am here to tell you that it is possible, at least with older hardware.

att just runs periodic check on the IMEI. and no iphone will be skipped (except for early pre 3g iphones, and those that have the smartphone exclusion)

AT&T doesn't offer a plan to enjoy the iPhone "to its fullest extent" (unless you're grandfathered).

You have several options:

A. Pay the data plan and consider ending the unlimited text. You might be able to use Google Voice for free texting using the data plan.
B. Get one of these texting/android phones w/o a data plan

This isn't always true.

I've had 2 or 3 different smartphones with AT&T that I purchased unlocked (not iphones) that I just put a SIM in an never had problems with autocharging for 3-4 years. It may be an iphone thing.

It would stand to reason that if the IMEI isn't recognized by ATT then they wouldn't put a data plan on your phone. There are tons of android phones which they don't have in their system because they don't sell them. I presume this is what he was referring to.
