Verizon Wireless rate increase - get out of your contract without paying an ETF
I found the following notice in my most recent Verizon Wireless bill:
Quote from the current Verizon Wireless Customer Agreement [verizonwireless.com]:
I believe this gives any affected VZW customer the right to get out of their contract without paying an Early Termination Fee. Note that the legal definition of "material" does not state or imply a specific dollar amount value, percentage, or any other number. Rather a "material" change is ANY change to the contract terms (yes, that means even if they increase a fee by one penny, that is a "material" change by definition). If this is incorrect information, I apologize, and please let me know so I can update the post.
If you talk to a CSR or any other VZW rep, they will first try to do whatever they can to avoid charging you the fee (or to give you an up-front credit). Other posters in this thread have indicated that you can refuse any credits offered and instead persist to have your contract cancelled without paying an ETF fee. The bottom line is that if VZW changes ANY terms in your contract, you have the right to cancel the contract without paying an ETF fee.
Note that if you bought your phone from Amazon Wireless, Wirefly, LetsTalk, or other discount cell phone shops, you may have a separate ETF that you will have to pay to the company you bought your phone from (typically only if you cancel your plan within 6 months of activation).

Quote : Notice Of Administrative Charge IncreaseEffective 1/1/2012, the monthly Verizon Wireless Administrative Charge for voice and email plans will increase from $0.83 to $0.99 per line for all eligible customers. The charge for Mobile Broadband customers will remain at $.06. For information regarding this charge, call 1-888-684-1888. Please consult your Customer Agreement for information about rate changes. |

Quote : Can Verizon Wireless Change This Agreement or My Service? We may change prices or any other term of your Service or this agreement at any time, but we'll provide notice first, including written notice if you have Postpay Service. If you use your Service after the change takes effect, that means you're accepting the change. If you're a Postpay customer and a change to your Plan or this agreement has a material adverse effect on you, you can cancel the line of Service that has been affected within 60 days of receiving the notice with no Early Termination Fee. |
