This is not a case of media spin.
Stealing is a taking with the intent to permanently deprive the rightful owner. If Lohan took the the jewelry with the intent of returning it at a later date, but simply did not have permission to take it in the first place, it is not a case of stealing. |

Like I said before, if Lohan's intent was to return the property...then she did not commit any act specified in the code you posted. |

Try that a car dealership. Take one out for a spin without asking....see how that works out for you.... I understand the elements of the crime of theft. That's what I am saying...if Lohan took the jewelry with the intent of returning it, but did not have the permission in the first place, then it's not stealing. She would have to prove she thought she had permission, and that it was reasonable for her to think that. Sorry if did not make the clear earlier. |
