HTC One S Pre-order at Costco Online for $164.99 after MIB for new/extended contract on T-mobile

I called and was told you only need to return the phone if you want a refund or to exchange (if you still have service). There is no penalty from Costco. I would call to double check yourselves, but that is what I was told.

so i can just cancel after a few days pay the etf and keep the phone?

According to the following (from the return policy page), you would need to return the handsets if service is cancelled within 90 days:

"The handset(s) you purchased reflects a discount based on activation of a service agreement with a wireless carrier. If for any reason you cancel your service or your service is terminated within 90 days of activation, the handset(s) you purchased must be returned in accordance with this return policy so we can continue to offer a value to Costco.com customers."

Could you do an upgrade on this phone and then return it to get the Galaxy S 3 when it comes out in May without a penalty?

You are assuming it comes out in May...me thinks you are getting confused with the announcement, which is very different, am I wrong?
