In Texas, 'stand your ground' case leads to murder conviction
Was he in reasonable fear for his life? Not clear to me whether the guy who threatened to get a gun, actually did threaten him with a gun. So if you're threatening someone with a gun (by showing it, maybe not pointing it) and someone counters with their gun, can you then shoot them? Apparently you can't always get away with that. |

I totally believe in the right to defend one's self, family and belongings, but this sums it up for me. If you provoke the fight, you can't claim you were defending yourself. Good verdict. |

So it seems incidents such as these are encouraged by 'stand your ground' laws, as people such as this guy believe they can kill someone they've provoked.
Seems contrary to gun enthusiasts' claims that this sort of protection for gun owners will not lead to more old west style shootouts. |

Not a lot of info, but it seems a bit of a stretch to walk over to your neighbors house, start some sh** because their party is too loud, and then run back to your own property just to shoot them.
I mean, does someone really think the 'birthday boy' is going to 'kill you' because you asked them to turn down the radio? |

The moron went and started crap, and instead of being polite or calling the cops, he pretty much shot the guy without much fear for his life or well-being.
NOT what the law was intended for. Had he been polite and one of the partygoes assaulted him, he would have had a case and it would have been justified. But he did not, so off to jail he goes. GOOD RIDDANCE!! |

I think what did this guy in was the video of him calmly claiming his life was threatened. The jury probably could not hear any fear in his voice and concluded it was a charade. |

has anyone seen the video? i've heard the audio. from that, it sounded pretty clear he was just going through the motions and using the key words that can be used to claim self-defense.
"My life is in danger now" and "These people are going to go try and kill me." He then said, "I'm standing my ground here," all came out deadpan. Rumble, young man, rumble. These are interesting times we live in. Punctuation is key. Fruit is nature's candy.
