2. ELIGIBILITY: The
Visa Prepaid 2012 My Payday Story (the “Promotion”)
is open to legal residents of the fifty (50) United States and the District of Columbia, 18 years of age or older as of July 23, 2012. Void in Puerto Rico and where prohibited. Employees of the International Olympic Committee (“IOC”), U.S. Olympic Committee (“USOC”), the Organizing Committee for the London 2012 Olympic Games, all members of participating national teams and their individual athletes, Visa Inc., Visa U.S.A. Inc. (“Sponsor”), Visa International Service Association, and their respective successors, affiliates and client financial institutions, prize suppliers and advertising and promotion agencies, Tenthwave Digital LLC, Facebook, Inc. and each of their respective subsidiaries, affiliates, agents, representatives, officers, directors, and employees (collectively, “Releasees”), and each of their immediate family members (spouse and parents, children and siblings, and their respective spouses, regardless of where they live) and individuals living in the same households of each of these individuals, whether related or not, of the above are not eligible to participate or win. Promotion is subject to all applicable federal, state and local laws. U.S. law governs this Promotion. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By participating, you understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for administration of the Promotion.
3. PROMOTION TIMING/DESCRIPTION: The Promotion begins at 7:00:00 AM Pacific Time (PT) on July 23, 2012 and ends 11:59:59 PM PT on September 16, 2012 (the "Promotional Period"). A total of twenty-five (25) instant win prizes will be awarded per day throughout the Promotional Period and one (1) Grand Prize winner will be selected in a random drawing sweepstakes (the “Sweepstakes”) at the end of the Promotional Period. Unclaimed instant win prizes will not be awarded.
4. PARTICIPATE: You may participate the Promotion through the Visa Prepaid 2012 My Payday Story Instant Win Promotion application (the “Promotion Application”) that appears on the Visa Prepaid Facebook page by going to www.facebook.com/visaprepaid. You must ‘like’ the page and click on the Promotion tab and ‘allow’ the Promotion Application in order to access the Promotion. You will be asked to complete and submit the online registration form including your first and last name, email address (associated with your Facebook account), date of birth, and to check the box confirming that you have read and agree to these Official Rules. Once you have successfully registered, you will be presented with a promotion page asking you to select from words in drop down menus to complete a story (“Promotion Participation Page”). When you have completed your story, click the ‘submit’ button (“Promotion Participation”) to receive a message indicating whether or not you are an instant winner. If you receive an instant win prize message, you are a winner of the prize indicated subject to verification of eligibility and compliance with the terms of these Official Rules and you will be asked to submit your mailing address immediately upon receiving an instant win prize message. If you do not submit your mailing address, your prize will be forfeited. If you do not receive an instant win prize message, you are not an instant winner. Twenty five (25) instant win prize messages will be seeded randomly by Sponsor per day throughout the Promotional Period. The participant who is the first to submit a Promotion Participation at a randomly seeded time, as determined by Sponsor, or the first participant to submit a Promotion Participation after a randomly seeded time if no one participates at a randomly seeded time, as determined and verified by Sponsor, will receive an instant win prize message. Each day you participates the Promotion during the Promotional Period, you will receive one (1) entry in the Sweepstakes (see Rule 5 below). Participation as often as you like but only your first Promotion Participation each day during the Promotional Period will give you a chance to win an instant win prize and result in one (1) Sweepstakes entry (collectively, “Instant Win Promotion Participation”). Limit one (1) Instant Win Promotion Participation per person and per Facebook account per day. Subsequent Promotion Participations by the same person or Facebook account on any day will only be for recreational purposes and will not provide such individual with an Instant Win Promotion Participation or entry. A “day”, for purposes of this Promotion, is defined as the 24-hour period beginning at 12:00:00 AM PT each day and ending at 11:59:59 PM PT the same day, except on July 16, 2012 when the day will begin at 7:00:00 AM PT. Promotion Participation must be completed during the Promotional Period in order to be valid. Proof of Promotion Participation and/or winning that is generated or provided by an entrant shall not be considered proof of participating and/or winning by Sponsor. Promotion Participation must be completed by 11:59:59 PM PT on September 16, 2012, when the Promotion ends. Instant Win Promotion Participations completed with the same or multiple Facebook IDs, under same or multiple identities or through the use of any agent or other device or artifice to participate or enter multiple times in a day will be deemed invalid. Incomplete Promotion Participations not complying with these Official Rules are subject to disqualification and will be deemed void. Registrations/Promotion Participations or entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Registrations/Promotion Participations that are electronically reproduced, copied, incomplete or inaccurate are void. All materials submitted in connection with the Promotion become the property of the Sponsor and will not be acknowledged or returned. If a dispute results as to the identity of a participant, it will be determined that the registration/Promotion Participation was submitted by the authorized account holder of the Facebook ID provided on the registration form. For these purposes, the authorized account holder is the natural person assigned to a Facebook ID by Facebook.com. Releasees (as defined above) are not responsible for late, lost, incomplete, damaged, inaccurate, delayed or misdirected Promotion Participations. Use of the Promotion application and Promotion Participation page, and Sponsor’s use of information submitted by entrant in connection with the Promotion, will be subject to the terms and conditions stated in these Official Rules as well as to the Sponsor’s Privacy Policy available at https://www.facebook.com/VisaPrep...9843487733. The Promotion Participation Page’s database clock will be the official timekeeping device for this Promotion.
5. HOW TO ENTER THE SWEEPSTAKES: You will automatically receive one (1) entry into the Sweepstakes for each Instant Win Promotion Participation during the Promotional Period. Limit one (1) Sweepstakes entry per person and per Facebook ID per day. Additional Entries: There are two (2) ways to gain additional entries in the Random Drawing: 1) Upon completion of an Instant Win Promotion Participation, you will be given the opportunity to earn additional entries in the Sweepstakes by inviting your friends to participate the Promotion through the Promotion Application on Facebook. Post to your Facebook wall/timeline that you have participated the Promotion. When a friend clicks on the link that appears in your post, “allows” the Promotion Application, completes and submits the online Registration Form and completes an Instant Win Promotion Participation during the Promotional Period (“Qualified Friend”), you will earn one (1) additional entry in the Sweepstakes for each Qualified Friend. Entries must be received by 11:59:59 PM PT on September 16, 2012 in order to be eligible for the Sweepstakes. Limit twenty (20) additional entries per person and per Facebook account per day. Subsequent entries received by the same person or Facebook account on the same day in excess of the stated daily limitation will be void; 2) To gain additional entries via U.S. Mail without inviting friends to participate the Promotion on Facebook, hand print your name, address, city, state, ZIP code, date of birth, email address and daytime telephone number on a 3” X 5” card, and mail it, in an envelope with postage affixed, to: Visa Prepaid My Payday Story Grand Prize Sweepstakes, P. O. Box 832, Plainview, NY 11803-0832. Mail-in entries must be postmarked by September 17, 2012 and received by September 24, 2012 in order to be eligible for the Sweepstakes. Each mail-in entry counts as twenty-one (21) entries in the Sweepstakes. Limit one (1) Sweepstakes entry request per outer envelope. There is a limit of twenty (21) Sweepstakes entries per person per day, regardless of method of entry. Entries received in excess of the stated daily limitation will be void. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete, postage due, late or inaccurate are void. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Proof of mailing does not constitute proof of delivery.
6. DETERMINATION OF WINNERS: Potential Promotion Participation winners will receive immediate notification online, subject to verification of eligibility and compliance with the terms of these Official Rules. The Sweepstakes for the Grand Prize will be conducted on or about October 1, 2012 from among all eligible entries received in order to award the Grand Prize. Drawing will be conducted by Tenthwave Digital LLC., an independent judging organization. Potential Grand Prize winner will be notified on or about October 8, 2012 by electronic mail and/or telephone. Potential Grand Prize winner will be required to verify mailing address within seven (7) days of email notification prior to issuance of Grand Prize. Non-compliance within this time frame or with the Official Rules, or if prize or prize notification is returned as undeliverable, will result in entrant being disqualified, and the Grand Prize may be awarded to a potential alternate winner. Allow 6-8 weeks for delivery of all prizes. If any winner is eligible but still considered a minor in his/her state of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. Limit one (1) Promotion Participation prize per person and per Facebook ID. All claimed prizes will be awarded. Judges’ and Sponsor’s decisions are final and binding in all matters relating to this Promotion.
7. ODDS OF WINNING A PRIZE: Odds of winning a Promotion Participation prize are approximately: 1 in 400. Odds based upon an estimate of 10,000 Instant Win Promotion Participations transacted each day over the Promotional Period; actual odds of winning instantly will depend upon the actual number of Instant Win Promotion Participations transacted and the dates and times of Instant Win Promotion Participations. Odds of winning the Sweepstakes Grand Prize depend upon the number of eligible Instant Win Promotion Participations received throughout the Promotional Period.
8. 9. CONDITIONS OF PARTICIPATION: By participating, participants agree to be bound by these Official Rules including all eligibility requirements and the decisions of the Sponsor and judges, which are final and binding. By accepting a prize, winners consent to the use of their name, image, likeness, photograph, voice, and biographical material for advertising, publicity, and promotional purposes by Sponsor, or party designated by the Sponsor, in any and all media now or hereafter devised, including but not limited to, any online announcements, worldwide in perpetuity, without additional compensation, notification, or permission, except where prohibited by law. Participants release and hold harmless Releasees from any claims, actions, injury, loss, or damage of any kind, including but not limited to, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Promotion or from the acceptance, possession, or use or misuse of a prize. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties. Participants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Promotion.
10. NUMBER OF PRIZES: No more than the listed number of prizes will be awarded. In the event of a printing, seeding, production, technical or human error, or for any other reason, the number of winning Instant Win Promotion Participations distributed or received for any prize level exceeds the number of prizes listed in these Official Rules for that level, Sponsor reserves the right to conduct a random drawing from among all non-suspect, eligible prize claims received to award the listed number of prizes for that level.
11. GENERAL: Sponsor will collect information from the participants solely for the purpose of the notifying the winners. Sponsor will not share this information with any third party, except as necessary for the administration of the Promotion or winner notification as applicable, nor attempt to contact entrant, unless entrant has agreed to receive further information on Sponsor’s products and promotions. Releasees are not responsible for lost, late, misdirected, inaccurate, incomplete, undelivered, damaged, delayed, or garbled Promotion Participations or Sweepstakes entries; or for any other errors or problems of any kind, whether typographical, printing, mechanical, human, electronic, or otherwise, relating to or in connection with the Promotion, including, without limitation, any error or problem that may occur in connection with the administration of the Promotion, the processing of Promotion Participations or Sweepstakes entries, the announcement of the prizes, or in any Promotion-related materials. Promotion materials that have been tampered with or altered are void. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Promotion at any time without notice, if in the judges’ opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness, or integrity and proper participation of the Promotion. In the event of cancellation, Sponsor may void any Promotion Participations it suspects are at issue and, award remaining prize(s) in a random drawing from among all non-suspect, eligible Promotion Participations received up to the date of cancellation. Caution: Any attempt by an entrant or any other individual to damage the web site or undermine the legitimate operation of the Promotion may be in violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify participants who violate these Official Rules or interfere with this Promotion in any manner. If a participant is disqualified, Sponsor reserves the right to terminate that participant’s eligibility to participate in the Promotion. Any attempt by an individual to access any website associated with the Promotion via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated promotion participation devices or programs is prohibited.
12. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the eligible participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
13. ARBITRATION: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.
14. WINNERS’ LIST: For the names of the major prize winners, available after October 31, 2012, mail a self-addressed, stamped envelope by October 31, 2012 to: Visa Prepaid 2012 My Payday Story Winners, P. O. Box 997, Plainview, NY 11803-0997.
