I would not trust this response. I am a police officer and I have charged numerous subjects with fraud crimes from Home Depot (mostly fraudulent returns). LP does not share their investigation or tactics with cashiers. I doubt Home Depot would actually prosecute, but I do believe this meets the statutory definition of fraud at least in North Carolina.
There's a reason why you are a police officer and not a lawyer. Now if you sell these on eBay. That might be fraud.

I have a friend who works for a company that supplies HD, you don't believe what profit margins they have, even at 50% off regular prices they are still in black. So I don't have any remorse .
Really makes me wonder about the training for some people. This is one of the most ridiculous claims for a crime being committed I've read in a long time.
The coupon has no intrinsic monetary value, it cannot be redeemed for cash. It cannot even be redeemed for gift cards. It is a discount coupon. PERIOD!!! A FREAKING DISCOUNT COUPON.
Whether HD choose to honor it, is entirely up to them. Whether you choose to proceed with a purchase if its declined is also entirely up to you. Quid Quo Pro.
There is NO DECEPTION HERE. You give up your email address and thus agree to receive more marketing email, they issue you a DISCOUNT COUPON, which they MAY/MAY NOT honor. For which you have to purchase something in order to receive the DISCOUNT.
Anyone who comes in here claiming you stole the coupon is a big joke. The system is giving it in exchange for adding you to the mailing list. End of discussion!!!.
I might have ethical questions about the coupon, but to stretch that to this?? Gimme a break.
