I have too, and hope he does as well. But saying it will be removed because there was no tax due is not useful for people who havent dealt with IRS before.
The law in practice is whatever the IRS agent who reads your letter decides it is. If you dont like that answer, you can follow the actual law they have spelled out for you on their website (which I personally prefer..it holds up better than someone saying they have done it before). Why argue?
