http://www.matousec.com/projects/proactive-security-challenge-64/results.php If you scan the latest A-V Comparatives reports, you'll see that while Eset consistently gets an Advanced+ rating, it's usually in the middle of that pack, behind G-data, F-Secure, Kaspersky, & Bitdefender. ...when I contacted ESET following my removal, they sent this: eBay use a generic term of “breaches intellectual property rights” when they notify sellers, which covers a multitude of reasons and not necessarily meaning “fake goods”. The hard facts are that we (ESET) have a blanket ban on the "unauthorised" sale of all ESET products through eBay for a number of legitimate reasons which is our legal right as owners of those intellectual property rights. Even if you have purchased or obtained a legitimate product and we are not disputing you have, if you are not an “authorised” ESET Reseller/Partner and if you purchase or obtain an ESET product you then become subject to ESET’s “End User License Agreement” (EULA), which clearly states ESET products cannot be transferred or assigned to third parties Eg "8. Transfer of License. You may not transfer or assign Your rights to the Licensed Program under this Agreement to a third party." So ESET Products/Licenses cannot therefore be “resold” to a third party without express permission from ESET. Even if you were an “authorised” ESET Reseller/Partner, part of our terms and conditions even for that community quite clearly state that ESET products cannot be resold on eBay by them without prior authorisation from ESET. To date we have had a large number of people attempting to sell "Cracked" or "Pirate" copies of NOD32/Smart Security software from various locations worldwide, one guy selling what turned out to be 30 day trial licenses which we give out free anyway and another selling "lifetime" licenses for a one off payment of $10 - clearly not a legal product because we don't have such a license and you cannot even buy a one year license legitimately for that price. Another had bought a valid single license boxed product with a serial number that needs to be registered to get a username & password and then resold the serial number multiple times (a serial number can only be registered once). We then have to deal with all these unhappy customers who have been conned or have a serial number or license that doesn't work. I have a CD on my desk purchased from eBay and purporting to be a “10 Year License” – No such thing. Some we have discovered selling only slightly under recommended price but still turn out to be pirate copies. If it's not a valid license we won't support it - if it is, support is only available from country of issue, so again, there is a support issue as well with multi country sales. Hence we have the blanket ban or we would physically have to purchase all of these items or get proof from every eBay seller to confirm legitimacy and that is very obviously not practical. We will therefore continue with the policy of removal for all ESET products listed on eBay that are not "authorised" by ESET and this was not an error.
