This got me looking around for other video game music and I saw on Last FM that they have all of the Donkey Kong Country Original Soundtracks available to download for free. Being a legit site, this made me wonder what constitutes a gaming soundtrack as being "free" or copyrighted? I know remixes are currently legal, but I'm specifically asking about OSTs.

I think OSTs that are not released in the US, including DKC, are a grey area. Though potentially illegal, you can't buy them here and there is also no one to police the copyright.

Music has a compulsory license (at least in the U.S.), but I have no idea if these guys are paying one. I doubt it. Even if the songs are not released on CD copyright should still applies since they are released in a different form (i.e. the games).

In other words, I'm pretty sure it is not okay for them to be remixing without paying for it, and the fact they are charging takes this even further into not okay.

Man, I'd be happy to pay for video game soundtracks if they were ever released in America. I purchased the Halo OSTs in MP3 format from Amazon, but games like Final Fantasy and Mario elude us. Is there not really a market for those? I'd assume it would be free money for companies like Nintendo or Square.

I do know sites like OC Remix have several links to copyright laws and "remixing" original music. It seems like it's perfectly legal as long as the remixer is offering the music for free.
