But his HOA has basically gone inactive.. He doesn't really know the origin of the graveyard.. But yea, it's not as if this is a brand new subdvision.. the house has been there for quite some time. I do remember someone saying in the 80's about how they've really "toughened up" the burying laws there. .it was some old person complaining about how in the old days you could buy someone pretty much anywhere you wanted to.. Very funny ![]() I just don't want to purchase a home and walk out my front door to a bunch of tomb stones That's a little to close to the dead than I want to be.I do remember when we went house hunting when we first got together, and it was over in NJ; and the house we looked at was directly across from an old cemetery; I said no thanks

Just a little advice from someone who was once on an HOA board: don't be an ass because then they will go after you. You moved into a community knowing full well that they had an HOA. You obviously know that you should have gotten approval for the fence and you also know that the fence you put in wasn't the type of fence you were supposed to put in. Why is the HOA the bad guy here? For enforcing the rules that you agreed to when you moved in? Seems like you are being the difficult one.
As for the idea that "well 6 others on my street have them so they can't do anything" you couldn't be more wrong. Did you even bother to look to see if those 6 got approval? All HOA records are public, so you can request to see them at any time. Maybe they got approval for them because they actually submitted a request and gave a good reason to deviate from the approved fence. You have no background knowledge on any of those fences so I wouldn't assume anything. One last thing to think about. The fact that you put up a fence on your property without approval (no matter what type of fence it was) is a violation in and of itself. You have no argument to defend yourself on that one. They didn't even have a chance to approve or deny your fence because you never submitted a request. Do not ignore this. They can fine you every day you ignore the notice after about 30 days depending on the state. Once they get to the maximum they can fine you, then they can lien your house. All of this can be done w/o suing you. All they have to do is prove you owe them money which they can easily do. The only thing they would have to sue you on is to have the fence removed, but given the information you gave they will also win that court battle. So, lets look at the choices. 1. Ignore it and possibly face fines, liens, a court battle in which you will have to fork out money for a lawyer and then most likely will not only have to take the fence down AND pay the HOA's legal fees. Even if all of this doesn't happen I promise you that they will fine you and lien your house because that is quite easy. 2. Work with the HOA to resolve the issue.
