i am not asking what corporate policies are, i dont care about them

this is a question about the transferance of a contract without a party acknowledging or accepting the contract that was entered into by a 3rd party....

Already answered. You accept contract entered by 3rd party when taking ownership from the 3rd party or when using the software (say on loan from the 3rd party) or you do not use the software legally.

You're allowed to do whatever you want until which point someone disagrees with what you're doing and then it's up to a judge to decide...coin flip.

so i emailed the EFF and they are f-ing AWESOME. They actually wrote me back already! What they said is that this was actually already explored by the courts when "bunny" something or other was given an XBOX by his girlfriend which he then modded. Microsoft took him to court for reverse engineering and the court found in his favor because SHE had accepted the TOS and EULA, Bunny never did.

This of course isnt legal advise and the circumstances will vary with every case but the EFF legal interns do this type of reseach all the time and i trust their judgement...

True, my statement was premature. For a work computer, you are not "required" to abide by the EULA. If some wrongdoing occurs and it traces back to your work computer, the software manufacturer will go straight to your company, not yourself. The rest of you being fired for misconduct is a separate consequence.
