Typically you never get a "brand new" car with exactly 0 miles on it. Even if they drove it off the transport tuck to Service Bay (to be prepped for selling after transport) it will start to spin the odometer. Or the handful of people that drove the car on test drives... all those miles count. That's why they usually only want you to go around the block and put 1-2 miles max per test drive...as not to reach that magic # to make it a "Used" Car. I'm sure that Magic # varies from state to state.

I don't think 2.2 mil is happening unless he gets some judge wanting to get in the spotlight. Instead of being out $5k though, the dealership will probably be buying him a car or two at least.
I believe I've found the solution to obesity in America. Hemispherectomy....no one uses it anyway.

More than likely, the cops parked in front of his house with their lights on (so all neighbors would know).. Then the cops pounded on the door, announced he was under arrest without him even getting a word in. The cops will assume the dealership is telling the truth, and let the judge sort things out. Guilty until proven innocent. And 2.2 million is not excessive damages at all. The dealership basically did malicious prosecution and lied to "get even".
