pretty sure the law on sex is written with AGE not age mentality in mind... If sex laws was written with age mentality in mind, most americans ( well mainly conservatives ) would be forbidden to have sex due to diminished mental capacity....

that would have probably the same factors that led to such a decision by those judges.. That they can't neither prove she consented or not consent to sex, and was convicted because he had sex with a person people would deemed so inappropriate without any real legal or just or scientific basis You cannot have individualistic freedoms and choices in a society, if we continue to view some people as never going to have such a right because they were burdened with a handicap.. this is the crux of gov't, that they see themselves as knowing better then the individual. i.e Big Brother... And in the eyes of our gov't we might as well all be handicap, since the gov't sees fit to make choices for us. I am questioning why some people feel that handicapped people should NEVER be able or allow to make a choice in their lives.. In fact that post is more pro-handicap then against, since I support handicap people be given the right to overrule their so call power of attorneys or care-givers choices for them... The only people who are anti-handicaps are the one who would take away their right to choices and consent merely because they see them as handicap.. Don't tell me how a society is judged by the care we give to handicap people, in the USA we have execute enough people who was deemed mentally deficient. We jail thousands of people with mental issues rather then provide needed treatment.. So before saying my comment was harsh, look at what OUR GOV'T has been up to... And our gov't has already been putting mentally challenged people to death or throwing them into prison where they are abused by sane criminals. And it seem some people here do not want to acknowledge that our own gov't is involved in atrocities, yet we have all the time in the world to fake the outrage at one single individual.. Individual crimes pale in comparison or seriousness to gov't mandated and authorized crimes in the whole scope of severity inflicted. No single individual criminal will ever achieve to do as much harm as our own gov't sanctioned crimes. I think Ryu-born is 100%... extreme yet showing another side of the story. (in his extreme views)
Here is the problem. He is presenting an extreme view, with no feeling (ie debating something from one side) The rest of you FEEL strongly for something and give your opinion, which unfortunately does not matter one bit because you are not on the supreme court of said state. Ryu, either is a giant asshole (incorrect) or is trying to show everyone that their are extremes to every side. Saying that someone cannot grant consent for sex, is the same as asking if they can consent to anything. If this person cannot consent to sex they are basically living as an extension of someone else that has to choose everything for them because they are legally unable to do ANYTHING. The court ruling, while wrong (in my opinion) shows that this person does have ways to consent to things. I believe nobody has the ability to say what she can or not consent to because how can they "prove" she has a mind of a 3 year old or prove that someone like her has NEVER bitten or kicked someone to stop rape. The part Ryu is arguing is the fact that if this was a story about someone who married someone that had a mental retardation, and then the person died and the person whom is mental was ruled unable to consent to being married, then you would all be arguing that they would be able to. while this is two differing sides they need to take each case, case by case. There is no "law" allowing them to use personal judgement and they are on the court system to follow any laws written in the book. Which they did. In Soviet Russia, Internet surfs you!
