Just says the owner has not cut them a check but it should be on the way. Same thing every time I call. Tired of calling, what is next? Been 50 days. I assume I need to send them a certified letter of some type. A friend of mine was telling me I don't need to go to small claims court. That there is a court I can submit paper work to and unless the manager can provide the correct form and proof for not returning deposit its open close. The judge will issue a letter forcing them to return it.

He bases it on the claim that it was never refunded. The Landlord has fifteen days to either return the money or itemize to the renter any money that was withheld.

By not itemizing, in writing, the reason he did not return the deposit, the Landlord has defaulted and the renter is due ALL his deposit back, and triple the amount if that's the law in FL, as it is in CA.
