or do I have to unlock it first through AT&T or EBAY and then just pop in the t-mobile sim card..will it then be activated? Will the unlock trigger the activation?? any help would be appreciated

So is everyone ignoring the line in the Terms of Service wireless agreement that says .....

"If you terminate your Agreement within three (3) days of accepting the Agreement, you will be entitled to a refund of your activation fee, if any, but you must return the Equipment purchased in connection with your Agreement."

Shows $499 here, as well as for the poster above me. Had one in my cart and now the price is changed to $499 as well. If you're planning on getting one, I'd jump on it soon!

How do we get around this? Rely on a saved chat with a CSR?
So you're just going to barge into a thread and ignore the others who have talked with CSRs and gotten confirmation that this only applies to on-contract phones.

Yes. The CSR chat posted that I saw doesn't say anything about getting to keep the phone. It just says you won't be charged monthly or activation fees. Now there are 29 pages and nothing was in the Wiki so...

Besides what a CSR says and what a written contract you agree to says are two different things. And the contract is the stronger of the two especially if you have no record of talking to a CSR.

But on the other hand I guess the worst thing that would happen is you have to return the phone. Possibly incur a small shipping charge.
