Evicting Tenant for Failure to Pay: 3-Day Notice or 30-Day Termination?
Hello,
My folks needs your help. We are first time landlord (not by choice, couldn't sell house).
Info
- House in California (so Tenant Friendly State)
- We allowed this family to rent our house from July 2011-July 2012; tenant signed a one year contract.
- After the contract was over, my folks and tenant verbally agreed to do month-to-month (not the wisest decision IMO); upon reading the contract, the month-to-month clause was not in the contract
- Tenant paid August and September rent as usual but as of today, Oct. 8, has not paid for Oct. rent
- My parents have left several voicemails, emails but no answer; did get a hold of the daughter-in-law (who doesn't live there) and said the tenant would call back asap (no call yet)
Here are
Option 1: 3-day Notice to Evict
Option 2: 30-Day Termination
What should we do? I have fears that if we choose option 1, they made drag this into court and prolong their stay; Or should we just give them 30 days and minimize our losses.
Our Goals/Priority:
1) Get them out of our house asap
2) Minimize any retaliatory damage to the house
3) Get Oct. rent
