I hope the guy wins the suit and gets a million or two. It will send a clear message to all the dealerships that you can't screw or intimidate people. |

if for some reason the person paid an extra 5k, what would his options be if the company wasn't willing to work with him about it? sue them in court over a written contract?

What about the rights of the customer? I'm sure the dealership will settle out of court. They would be foolish to take this trial. They could lose even more money. But they deserve to pay something for how stupidly they acted. You don't say someone stole a vehicle - that's grand theft auto and a felony. You don't throw out charges like that when it was a clerical error. If you practice bad business, then you deserve to go out of business. Chevy should give someone else the dealership. Someone who knows how to run a business. |

Second point- Yes, that would be his option and he win if the contract said he over paid 5k or lose most likely lose if the contract stated the amount he paid was correct. |

If you see it overall the point is mostly retaliating against the dealership. Someone mentioned and its very truth that how many times have dealerships added an additional $5600 yet they dont get arrested? Dealerships usually always make the consumer overpay unless you have done all your homework and are very prepared to work a good deal. Is 2.2 million a bit to much yea, but its to show dealerships not to get ahead of themselfs and think they can do whatever they want like arrest someone for there own mistakes. If the dealership was smart they would of gone and negotiated this with the guy instead of have him arrested and sent to jail.

The moral thing to do would be to sign the new contract and keep the verbal agreement. Legally, I think the customer is okay. I do think the car dealer should have taken the customer to civil or small claims court for the difference. Small claims usually tap out at 5K but they would have gotten the bulk of their money back. Unfortunately, they overreacted and sent the repo man and the police to intimidate and arrest the customer. A mistake in paperwork is not grand theft auto. Personally, I would have gone back and signed the new contract since I agreed to it. Legally, the dealership may have screwed themselves with their clerical error. Either way, the damage is done and they are facing a serious lawsuit that will cost them dearly. |

If I, as an informed consumer, know exactly what car I want with exactly what options; and I have financing or cash in hand - I STILL have to go do the negotiation dance with the dealer & pay them THOUSANDS of dollars more than they paid to the manufacturer for that car. Dealers add zero value to informed buyers, but we're still forced to pay their overhead. Yeah, I don't feel sorry for the dealer at all in this instance. |
