Clarification: The 14z Black Friday deal was NOT the ultrabook still available, it was an older 14z model.

"Dell advertised a "doorbuster Black Friday" special of a Dell Inspiron 14z ultra-lightweight ultrabook with an MSRP of $639.99 for only $299, with free shipping to those who visited their website at 12:01 AM on 11/24. I stayed up later than usual to accept this offer. I spent an hour waiting on slow server responses to finally get an order confirmation page and a corresponding confirmation email at 12:54AM; then I went to bed satisfied that I had ordered a product that met my needs during the limited "Black Friday" timeframe. I saw many equivalent laptop deals from other sources over the weekend, but had my order confirmation so I did not pursue any of them.

At 12:01AM on 11/26, AFTER all of the Black Friday weekend sales had ended I received an email from Dell informing me that they "regret the inconvenience" but they ran out of the ultra-lightweight ultrabooks which I had ordered, so they would automatically be shipping me a bulkier, larger and inferior laptop, minus the bundled Adobe software for the same price instead. The replacement they are offering has absolutely no advantages over the ultrabook that I ordered. The replacement has a lower MSRP of $568.99, it weighs 26% more, has USB2.0 ports as opposed to USB3.0, has a lower-resolution screen, has a reduced battery life, is missing the promised Adobe Photoshop bundle, and it also has a touchscreen-based operating system installed on it despite not having a touchscreen! I called the 1-800 number provided in the email and was told by a CSR that my only alternative to receiving the inferior replacement was to cancel the order entirely and then have no laptop at all to show for my "Black Friday" shopping.

Meanwhile, Dell still offers these 14" ultra-lightweight ultrabooks for immediate sale (says ships next business day) on their website albeit with Windows 8 now replacing the preferred Windows 7:

I believe Dell used bait-and-switch to lure my business away from their competitors and is now trying to charge me the agreed on price for an inferior product, knowing that I have no alternative but to walk away from the soured deal. I am no longer able to take advantage of their competitors "Black Friday" sale pricing to get an equivalent price on a laptop I actually want and Dell is using this knowledge dishonestly to coerce me into paying for inventory they are trying to offload. If they were honest they would have informed me of the shortage before the annual sale-event weekend was over so I could find something else, and if they were earnest they would have provided an equivalent ultrabook in substitute. Instead, they waited until after the sales were all over, and then offered me an inferior laptop.

I reply to my cancelation email with this one and CC to all these DELL emails addresses and foxnews:

First thinks first, how in the world will you call this an updrage ???
Older model (release in 2009), heavier, bulkier, lesser MSRP value, no USB 3.0, no MS Office Starter, less battery run time, no multipoint touchpad, just to name some of the disadvantages.

I’m purchasing this laptop for my 7 years old daughter and that is exactly why I spend almost a month researching what laptop will be the right one for her, lightweight, small but still big enough to support a build-in dvd so she can play movies on it. Now you guys think all of my effort was in vain and since you are such a powerful company can decide what is good for her.

You guys have to stop this madness of randomly canceling peoples order and making decision by yourself without customer’s approval. And when I said randomly is because a can prove that is the way it is. I was one of the first ones to place the order that day. The sale started at 12:00 and I received my order confirmation at 12:16 am. I know people who placed the order 2 hours later and still they are getting what they ordered.

Now Black Fridays in gone and since I choose you over all other options available at that time I missed the opportunity to buy a good deal from somebody else. Is this how DELL pays loyal customers?

Just for the records, I do not agree to get this DOWNGRADE and this email will be my evidence. I already waste enough time to be on hold on the phone for 2 hours. And if you guys can send email to your customers to validate and order change I can do the same.

I want what I ordered. I don’t care if I have to wait. I’m not dealing with BestBuy here; you guys are a computer manufacture and can produce as much computers as you want. If you guys don’t have the parts now you will have them later. In my opinion not having the supplies is the lamest excuse ever; you are still selling 14z on your website today.

There are hundreds of unhappy customers all over the country with this bait and switch strategy of yours. People are filling complaints left and right all over the web. Here is a good place for you to validate this:

Here is my timeline (EST):

Received order confirmation email: ~1:45am 11/23 (maybe later, can't remember)
Actual timestamp on email: 1:01am 11/23
Change to Inspiron 15 email: 2:00am 11/26
14z Order Delay email: 7:56am 11/27 (order delayed until 12/14)

My Dell account only shows 1 order for the 14z and it's "In Production". Estimated delivery date is "12/14/2012 (Updated)".

I'm not getting my hopes up yet... I'm still anticipating it changing to the Inspiron 15 at some point. I still haven't contacted Dell in any way. Though there still seems to be a fraction of a chance that they are fulfilling some of the 14z orders.

In the meantime I'll look for another deal since I wanted Windows 7 and preferred the smaller, lighter laptop. If I find something and it's too late to cancel the 15, I'll just refuse it or return it (free returns including shipping [dell.com]).

I received the "upgraded to the Inspiron 15 email" as well. I logged into my Dell account today. Under "Recent Orders" shows Inspiron 14Z in production with 12/13 estimated ship date. No mention of cancel or changed order.

Under "Order Details" also shows 14Z in production and detailed under "Items Purchased". No mention of cancel or changed order.

We will see.....

I read Dell terms of sale again, it says when a product is discontinued, "Dell will ship Product that has the functionality and performance of the Product ordered, but changes between what is shipped and what is described in a specification sheet or catalog are possible."
Here I replied their changing notification email saying that the Inspiron 15 doesn't have the "ultra-potability, a main functionality promised in 14z"
Anybody ready to file a class lawsuit, since Dell is not fulfill their terms of sale, which is contact between us and "they"?

Wow... no emaill or order status after the initial confirmation email. Now chatting with rep tells me order never went through due to configuration error. Anyone not seeing their order or been given this excuse?

Weird, the order number that I used in the BBB and FTC complaint still shows 14z with an updated delivery date of dec 13. The other two order numbers show order changed or canceled.
Wonder if I should file a complaint for each order number... Wink

Good find, yes this would not allow them to swap the 14z for a heavier bulkier 15 the way I read it

Don't take it.

The CSR rep said she's been handling the 14z calls since the morning. She sounded a little edgy. I don't envy her job.

Exactly, do not give in. They know they are in a bind and are trying to sneak themselves out of it. It will not work
