Bait-and-switch happen to you? Here's a list of places to send complaints to:

(1) BBB [bbb.org] (has email link to Dell, as well as ability to "File Complaint against Dell [bbb.org]")
(2) FTC [ftccomplaintassistant.gov] (Use Dell info. here [computerhope.com] to fill this out, if you don't know.)
(3) Bulk Email Exec's (a number of those emails bounced/failed sending)

For all the areas asking for details, you can modify Cabrill's well-worded letter from his post. All the info. relating to your order (i.e., order #, account #, etc. are in your email from your Order Confirmation). If you want more info., like a copy of the BBB report, go to my post & fellow users around that page.

I started a groubal [groubal.com]. Please sign.

Clarification: The 14z Black Friday deal was NOT the ultrabook still available, it was an older 14z model.

Generic message for the lazy ones (Credit goes to Cabrill)

"Dell advertised a "doorbuster Black Friday" special of a Dell Inspiron 14z ultra-lightweight ultrabook with an MSRP of $639.99 for only $299, with free shipping to those who visited their website at 12:01 AM on 11/24. I stayed up later than usual to accept this offer. I spent an hour waiting on slow server responses to finally get an order confirmation page and a corresponding confirmation email at 12:54AM; then I went to bed satisfied that I had ordered a product that met my needs during the limited "Black Friday" timeframe. I saw many equivalent laptop deals from other sources over the weekend, but had my order confirmation so I did not pursue any of them.

At 12:01AM on 11/26, AFTER all of the Black Friday weekend sales had ended I received an email from Dell informing me that they "regret the inconvenience" but they ran out of the ultra-lightweight ultrabooks which I had ordered, so they would automatically be shipping me a bulkier, larger and inferior laptop, minus the bundled Adobe software for the same price instead. The replacement they are offering has absolutely no advantages over the ultrabook that I ordered. The replacement has a lower MSRP of $568.99, it weighs 26% more, has USB2.0 ports as opposed to USB3.0, has a lower-resolution screen, has a reduced battery life, is missing the promised Adobe Photoshop bundle, and it also has a touchscreen-based operating system installed on it despite not having a touchscreen! I called the 1-800 number provided in the email and was told by a CSR that my only alternative to receiving the inferior replacement was to cancel the order entirely and then have no laptop at all to show for my "Black Friday" shopping.

Meanwhile, Dell still offers these 14" ultra-lightweight ultrabooks for immediate sale (says ships next business day) on their website albeit with Windows 8 now replacing the preferred Windows 7:
http://www.dell.com/us/p/inspiron-14z-5423/fs

I believe Dell used bait-and-switch to lure my business away from their competitors and is now trying to charge me the agreed on price for an inferior product, knowing that I have no alternative but to walk away from the soured deal. I am no longer able to take advantage of their competitors "Black Friday" sale pricing to get an equivalent price on a laptop I actually want and Dell is using this knowledge dishonestly to coerce me into paying for inventory they are trying to offload. If they were honest they would have informed me of the shortage before the annual sale-event weekend was over so I could find something else, and if they were earnest they would have provided an equivalent ultrabook in substitute. Instead, they waited until after the sales were all over, and then offered me an inferior laptop.

Here are the specifications of what I ordered:
Intel Core i3-2350M processor 2.30GHz
4GB DDR3
500GB HDD
14" 1366x768 LED monitor
Intel HD Graphics 3000
8X CD/DVD Burner
Intel Centrino Wireless-N 1030 & Bluetooth
USB 3.0
6-cell Battery
Windows 7 Home Premium 64-Bit
Adobe Elements 9.0 Photoshop and Premiere Bundle

Dimensions & Weight:
Height: 0.998"
Width: 13.6"
Depth: 9.7"
Weight: 4.12 lbs

Here are the specifications of the replacement:
Intel Core i3-2350M processor 2.30GHz
4GB DDR3
500GB HDD
15.6" 1280x720 LED monitor
8x Tray Load CD/DVD Burner (DVD+/-RW Drive)
Dell Wireless card 802.11 b/g/n (2.4G), BT+HS
USB 2.0
6-cell
Windows 8, 64-bit, English

Dimensions & Weight
Height: 1.36"
Width: 14.8"
Depth: 10.24"
Weight: 5.2 lbs

I want the ultrabook that was described in my order confirmation or its equivalent. I will not accept the bait-and-switch of an inferior laptop at the same price.

This is the ultrabook that I ordered and want delivered for the agreed price of $299.99:

I received the following email from a Dell CSR today:
Quote :
Dear <Cabrill>,

This is with reference to the email that reached our Corporate office. We appreciate you having taken the time to bring our attention to this incident. We sincerely apologize for the inconvenience caused to you. The Inspiron 14z sold out within the first few hours of the promotion.
We are replacing your Black Friday order with an Inspiron 15 at no additional cost. If you wish to order another laptop, we can cancel the order for the Inspiron 15 and give you a $100 discount on the laptop you choose.

Please let me know the option you would prefer.

Regards,
Gerard James

Hello Gerard,

I would like to thank you for taking the time to respond to my complaint; however, had you actually read it you would know that I placed my order within an hour of the deal going live, not after "a few hours" and the only reason it took as long as it did was due to the very poor performance of your webservers. Additionally you would know I am already aware you are offering a bulky notebook in place of the slim, ultrabook that I ordered and that is the source of my complaint - not the resolution. Also, you make it sound like you're doing me a favor by offering me a larger, heavier and technically inferior device which has a lower MSRP than the ultrabook that I ordered. Why exactly would there be an "additional cost" associated with giving me such a device in the first place?

I see you still have the Inspiron 14Z available for order on your website, if you are able to apply your offered $100 discount to make the total on one of these the agreed upon $299 then that would resolve my complaint. Otherwise, your offer is not satisfactory. I had an order confirmation for an Inspiron 14z ultrabook for $299 and because of that confirmation I did not pursue any of the myriad other ultrabook deals that were only offered during the Black Friday sales event weekend. I specifically chose Dell's offer of all the choices available, and I now regret that choice.

Dell waited until AFTER the weekend was over to notify me of a shortage that should have been immediately detected. Is Dell's inventory not tracked electronically? Do you have no automated system to limit sales to the inventory available? No way to immediately detect when sales exceed inventory? Those are standard precautions for ANY business, let alone a computer company.

I am no longer able to take advantage of the aforementioned Black Friday deals, completely due to Dell's delay, so I expect Dell to complete the order that Dell confirmed and that they maintained confirmation of throughout the weekend. Unless you no longer make Inspiron 14z's (Dell's website says otherwise) then you have no excuse for not fulfilling the order as placed. I believe you are purposefully withholding the 14z so that you can make a profit on the undesirable Inspiron 15, which is 2 years older, lacks USB3.0, has a reduced battery life, weighs 26% more and has a lower screen resolution, with a much lower DPI. One extra inch of screen in no way offsets all of those detriments.

If you are only offering me the Inspiron 15 notebook while you continue to sell the Inspiron 14Z ultrabook then that is the textbook definition of bait-and-switch, and in addition to the BBB I will also report Dell's marketing practices to the FTC and the Attorney General in Texas. I look forward to your response and proposed resolution to Dell's dishonest sales practices.

Thank you,
<Cabrill>

Totally agreed. There is nothing to worry about. Just let them deliver and if you don't want to dispute with CC, just return the package for free. The more we wait, the more worry they will have. Just sit tight and wait for the delivery.
Yes I agree...this makes them to produce more and more junk 15s now and later they have to suffer to sell them even for 199.

Great article by Catherine, big thumbs up to her!

As she illustrated, this issue is not just about money, it's about fairness, business ethics, and messing with people's lives.

I would gladly trade a 14z for all the hours I wasted on this stupid process, but it's too late. I AM absolutely irate for losing precious time and energy I could have used on enjoyable pursuits and time shared with loved ones. That matters more to me than anything, and for that, I will pursue this issue to see that Dell does not escape repercussion for treating its customers like dirt and robbing us of our time and money.

they are talking BS , they train these indian guys to tell this and talk to us.. surely some of the people here on SD also got the laptops if it was pricing error then they would have not got it , also the order numbers before that are cancelled so this is not even first come first server , dell is a big time scam , i bet they knew all this and they were aware of this situation ...
This is DELL management issue not the CSR's...they are just employees and do whatever company says.....

Wow, just as I thought Dell couldn't possibly screw this up any further:

Dell canceled my two orders of 14z (expected).
Sent an updated email telling me that I'm now only getting ONE (1) Insp 15 for my customer ID.

Then the best part is - instead of sending it to my mailing address, which was clearly indicated on my original order confirmation, they're now sending it to my billing address. Which will have no one available to pick up the package. Freaking Dell's website won't me let change the mailing information either (only billing). Now I have to freaking call them up and adjust this BS also.

This afternoon I got a call from them and said that its a pricing error, they don't know how many reason they are telling to all the customers. Each times different story. I said them at please cancel my order and good bye to dell. Right after the call they have cancelled my order, but just now I got an email with the new order for 15. WTF...

I got an email from a Dell Executive Customer Service rep named Shawn in regards to my BBB complaint. He simply said he tried to call me but was unable to reach me and asked for an alternative number. I did not receive any missed calls today! Well let's hope he offers a better solution than what is already presented when he calls me back tomorrow... the Inspiron 15 that they switched me to without my consent has been in the "order processing" stage for 2 days! Maybe I should be glad they haven't shipped it yet?
