"Dell advertised a "doorbuster Black Friday" special of a Dell Inspiron 14z ultra-lightweight ultrabook with an MSRP of $639.99 for only $299, with free shipping to those who visited their website at 12:01 AM on 11/24. I stayed up later than usual to accept this offer. I spent an hour waiting on slow server responses to finally get an order confirmation page and a corresponding confirmation email at 12:54AM; then I went to bed satisfied that I had ordered a product that met my needs during the limited "Black Friday" timeframe. I saw many equivalent laptop deals from other sources over the weekend, but had my order confirmation so I did not pursue any of them.

At 12:01AM on 11/26, AFTER all of the Black Friday weekend sales had ended I received an email from Dell informing me that they "regret the inconvenience" but they ran out of the ultra-lightweight ultrabooks which I had ordered, so they would automatically be shipping me a bulkier, larger and inferior laptop, minus the bundled Adobe software for the same price instead. The replacement they are offering has absolutely no advantages over the ultrabook that I ordered. The replacement has a lower MSRP of $568.99, it weighs 26% more, has USB2.0 ports as opposed to USB3.0, has a lower-resolution screen, has a reduced battery life, is missing the promised Adobe Photoshop bundle, and it also has a touchscreen-based operating system installed on it despite not having a touchscreen! I called the 1-800 number provided in the email and was told by a CSR that my only alternative to receiving the inferior replacement was to cancel the order entirely and then have no laptop at all to show for my "Black Friday" shopping.

Meanwhile, Dell still offers these 14" ultra-lightweight ultrabooks for immediate sale (says ships next business day) on their website albeit with Windows 8 now replacing the preferred Windows 7:

I believe Dell used bait-and-switch to lure my business away from their competitors and is now trying to charge me the agreed on price for an inferior product, knowing that I have no alternative but to walk away from the soured deal. I am no longer able to take advantage of their competitors "Black Friday" sale pricing to get an equivalent price on a laptop I actually want and Dell is using this knowledge dishonestly to coerce me into paying for inventory they are trying to offload. If they were honest they would have informed me of the shortage before the annual sale-event weekend was over so I could find something else, and if they were earnest they would have provided an equivalent ultrabook in substitute. Instead, they waited until after the sales were all over, and then offered me an inferior laptop.

yea. why are people referring to ultrabook and the new model in this thread. the deal didn't seem that amazing to me when the thread first open but this laptop caught so much attention. it was a 2nd gen i3 with intel hd 3000. still nice deal but that bait and switch is horrible

i dont know much about it is illegal to record , but it is must with these guys they keep changing one guy talks and then backs out , you can see many reported they saying it was pricing error now i was fighting about that the same guy today said , i never said it and i dont know what you talking , i am like wtf , you u kidding me so i did have this app , they calling me and i am not calling them and recording i am struck with indian they have no idea what they talking about , pure crap and just there lies making me frustrate more, how u submitting claim via attorney general could you please share

Too bad, I don't have any lawyer/attorney buddy. Otherwise, I will ask him/her for advice.

I believe you and other SDler's words. Plus, I think Dell's upper management team purposely asked their mid-level management or customer service team to give us a hard time. Just fill out the page carefully and truthfully. I believe Attorney General is serious business. I heard many businesses got sued by them including doctors' medicare scam, etc..

To those saying the original deal was not for an Ultrabook, thanks for the correction; although I don't believe there is a firm definition of what an "ultrabook" is, just that it's an extremely slim laptop and the 14z is most definitely slimmer than the 15. Old model and newer.

We regret to inform you that we would not be able to send you an Inspiron 14Z or an Inspiron 15R. Your order is in the process of being cancelled and re-entered with an Inspiron 15. We will update you on the status of the order.

I have an older 14z model and in no way I can consider it slim or "slimmer" than the 15N they offer. Lighter - yes; otherwise the same low-end look and feel.

So I am not going to get overly upset over 14z->15n switch. I will just try to flip it and get what I want. I signed the Grubal petition, but from my past experience this leads nowhere. Also, the way I see it, the "bait and switch" would not stand because Dell obtained your implicit consent when they offered to ship a different product or cancel the order. By not cancelling the order we implicitly agreed to the switch... I am sure they consulted their legal team about this action, so I wouldn't even go there.

Has anyone else been having problems with the BBB site? I've been going to the page "File a Complaint: Dell Inc" but when I hit continue, I always get an error. I've tried chrome and firefox yet neither works. The FTC site had no such problems.

And at this point, there is NO WAY I am keeping the 15 or buying another of their laptops to walk around with a stupid dell logo in my hands. I don't even care if it's cheap, I'd rather pay more on another brand. It's the principle, and if we as consumers don't vote with our dollars, then we facilitate and condone the continued use of their abusive practices.

Yes, I noticed Dell does have a legal counsel like any other major companies (found on a list of top management). At least we tried our best to fight for it. We have done a lot of damages on their public relations. Found this news on wikipedia.

In July 2009, Dell apologized after drawing the ire of the Taiwanese Consumer Protection Commission for twice refusing to honour a flood of orders against unusually low prices offered on its Taiwanese website. In the first instance, Dell offered a 19" LCD panel for $15. In the second instance, Dell offered its Latitude E4300 notebook at NT$18,558 (US$580), 70% lower than usual price of NT$60,900 (US$1900). Concerning the E4300, rather than honour the discount taking a significant loss, the firm withdrew orders and offered a voucher of up to NT$20,000 (US$625) a customer in compensation. The consumer rights authorities in Taiwan fined Dell NT$1 million (US$31250) for customer rights infringements. Many consumers sued the firm for the unfair compensation. A court in southern Taiwan ordered the firm to deliver 18 laptops and 76 flat-panel monitors to 31 consumers for NT$490,000 (US$15,120), less than a third of the normal price.[121] The court said the event could hardly be regarded as mistakes, as the prestigious firm said the company mispriced its products twice in Taiwanese website within 3 weeks.[122]

Shawn Arundale replied to me via BBB. I didn't even bother to call this liar.

Thank you for providing a copy of the customer submission. Dell had a promotion for a Dell model 14z computer with a Windows 7 operating system. The volume of orders was much greater than the number of computers available for sale and the promotion was limited to the quantity on hand. Dell no longer offers the model 14z computer with a Windows 7 operating system however, for customer satisfaction reasons, for customers who placed an order during the promotion; Dell offered a comparable Inspiron 15 computer with an upgrade to the newer Windows 8 operating system. These customers have the option of accepting the different model computer, at the original promotional price, or cancelling the order. Dell representative, Shawn, is attempting to reach the customer by phone and email however, we have not yet been able to discuss the contents of the submission. We remain available to assist and ask that the customer contact the representative at Shawn_Arundale@

Until I see formal legal statutes that states that companies are able to obtain implicit consent to change the conditions of a transaction by means of "if-you-don't-say-anything-we'll-assume-it's-okay-to-do-whatever-the-hell-we-want," I'm simply not buying that bullshit.
