How are checkpoints constitutional?

The simple fact is that, atleast out here, it's not against the law to have a DUI checkpoint and once they're already over they're free to look for other infractions. Again, don't blame me, don't blame the cops, where you should be putting the blame is on the illegals and those that support them. If they weren't such an obvious problem (for certain areas) there wouldn't be a need to check up on people as much to make sure they had a valid d/l and insurance...

So when a police officer knocks on your door and politely asks to search your house for drugs (without warrant, of course), you will have absolutely no problem allowing him in and giving him a tour of your house since you can easily show him around the house, right?

They're not.

The police to DUI checkpoints once a week in the city where I live. The local newspaper publishes the results. Usually, 1200 cars/drivers checked, 1 person picked up for DUI, about 10 for other reasons (like a headlight out). So to inconvenience 1200 people, they nab 1 person under the influence.

Also, most people are not aware that the TSA, yes those people, have been setting up roadside checkpoints nowhere near airports and "searching".

They put up with it because of organizations like MADD who argue that the ends justify the means. They reason that the invasion of your personal liberty is worth trading off for protecting people from DUI accidents. We can thank Justices Scalia and his friends on the court for upholding the constitutionality of DUI checkpoints under the U.S. Constitution. There are some states that do NOT allow checkpoints because of additional rights their citizens are afforded under state constitutions. The trend seems to be leaning this way. Unfortuantely, Scalia and friends are still chipping away at the Fourth Amednment as far as your federal rights are concerned, though.

We all automatically agree to these things by having a driver's license. they are constantly changing/updating the laws, but as long as you have a valid driver's license, that means you agree.
