Now if another state (ahem.. Arizona) were to pass laws that conformed with federal laws on illegal immigration.. they can't enforce them.. and the federal government won't enforce them. Alot of cherry picking going on with enforcement or "laws" (state or federal). |

Interesting Constitutional conundrum. Federal laws supersede state laws as per the Constitution. But the Constitution says nothing about states being obligated to enforce federal laws.

The federal government cannot infringe on the right to bear arms as per the Second Amendment, thus the supremacy clause is invalid for such a situation.

The problem is that the forefather's couldn't anticipate how poorly people would be educated, how much disinformation they would tolerate/accept, nor could they anticipate how far we would go in allowing the government to use our money against us.
Democracy only is effective in an educated and properly informed society, which is something we no longer have for the most part. Which is why our freedoms are eroding so rapidly. Personally, I'm interested in keeping other people from building Utopia, because the more you believe you can create heaven on earth the more likely you are to set up guillotines in the public square to hasten the process. -- James Lileks

Based on your above account, I have come to the following conclusion: IF Texas refuses to allow local and state police to enforce federal laws, THEN the federal government will SPEND MORE MONEY to expand the ATF division to take over the policing work that the Texas cops refuse to do. In other words, the Federal police force will expand in size. |
