Texas bill would block police from enforcing new federal gun laws

Texas is drawing a line in the sand, it would seem. We can sit around and say something is unconstitutional until we are blue in the face, but it functionally means nothing until the government decides to recognize that it is so. Which incidentally is also one of the reasons the second amendment is so critical.

Texas can at its own discretion choose to not recognize that the federal government has the authority to enact, or in particular enforce such a law within its borders. The federal government can choose not to like that, but short of military action, there isn't much it can do about it..

Under the supremacy clause of the U.S. Constitution, Texas law is superseded by federal law and thus, Texas law enforcement officers cannot enforce laws that are invalid in the eyes of the Constitution.

If Texas were to stop the federal government from enforcing federal laws that supersede Texas laws as per the Constitution, Texas would be engaging in treason and/or rebellion. The governor may be arrested and tried for treason in a federal court.

And if any federal officer attempts to exercise power not delegated by the constitution, he should be tried for treason in a federal court.

false...federal supremacy applies to constitutional laws and responsibilities of the federal government. If the federal government oversteps its authority, the supremacy clause does not apply. The supremacy clause is meant to ensure the uniform application of federal constitutional powers, NOT to allow a tyrannical federal government to run over the states...remember, the STATES created the federal government, NOT the other way around

I'm particularly interested in how firearms manufactured and sold within the same state might not fall under "interstate commerce," and therefore not be subject to the NFA and similar laws.

It probably will not fall under the "interstate commerce" if the state can guarantee that such products will not be sold or moved outside of state borders.

How about Wickard v. Filburn? You know, where someone raising a crop for their own personal use was crapped on because by doing so he was *not* buying it from "the market" (read: interstate commerce) and therefore the gov't had the right to stop him?

It would be an extension of that ruling. A person manufacturing a gun and using it in the state would be engaging in interstate commerce because said person cannot guarantee that the manufactured gun will not be sold outside of the state or cross state borders after the sale.

Gimme a break. If I sell my house, I can't guarantee someone wouldn't put it on a semi and have it cross state borders either.
