A federal court has preliminarily approved a $1.4 million class action lawsuit settlement between Humphreys Pharmacal and consumers who allege they were duped into purchasing the company’s homeopathic remedies based on misleading and confusing claims about their efficacy and ingredients. If you purchased a Humphreys homeopathic product within the past five years, you may be entitled to receive up to $10 cash for each eligible product you purchased.
The Humphreys homeopathic settlement will resolve a class action lawsuit, titled Nigh v. Humphreys Pharmacal Inc., et al., that alleges Humphreys and its parent company, Dickinson Brands, falsely or deceptively labeled and marketed Humphreys homeopathic products sold in the United States.
Defendants deny any wrongdoing but have established a $1.4 million class action settlement fund to pay claims to eligible Class Members. The settlement has been preliminarily approved by the court but is still subject to final court approval.
Class Members of the Humphreys class action lawsuit settlement include all U.S. consumers who purchased one of the following Humphreys homeopathic products for personal or household use from June 20, 2008 to June 29, 2013:

As a Class Member, you’re entitled to receive a cash payment if the settlement is approved. Class Members that can provide Proof of Purchase will receive a refund of the purchase price up to a maximum of $10 per product, subject to a cap of $100 per household. If you don’t have proof of purchase you can still submit a claim, under penalty of perjury, affirming you purchased the product(s) and receive up to $10 per product, with a cap of $50 per household.
The only way to receive a cash award from the Humphreys settlement is to submit a valid Claim Form no later than June 19, 2013.
A Final Fairness Hearing is scheduled for October 21, 2013.
