bought a messed up car:(

I don't post much but I bought a 2011 ford fusion with a clean car fax and it had 50000 miles. Everything went well until I smelled Coolant leaking and upon inspection the hose was rubbing the pulleys on the motor. Easy fix had a dealership near me replace the hose and it was paid in full from where I bought it.. Now it gets bad.. Dealership I brought it to tells me it's been badly damaged and the sub frame along with other parts are badly bent. I just made my first payment so It's been like 29 days from the day I bought it. The dealership picked out a 2012 fusion with no sun roof, no back up sensors but less miles and a year newer but not the color my wife wants.. Do I have any room to stand? Or do I just be happy they are letting me trade mine in and get that car? Thanks

Look into lemon laws in your state. Ak has none so you'd be screwed here.

Take the better car in the color your wife can get used to.

Well, for one thing you don't rely on a Carfax alone. Did you have the car checked out before you bought it? And did the seller make any representations about the car?

Did oyu buy it form the same place that wants to give you the newer one?

Ya I figured the car fax thing out on this buy lol and no unfortunately I thought since it was a really big ford dealership it would all be good and yes they are offering the newer model

Seriously take their offer, or ask for a different offer that satisfies you. But I really suggest you get out of your current car deal. It seems like they are willing so they know they messed up badly. Do it now so you dont regret it down the line.

I think the reason they are making you this offer is because they did not disclose the issue and are liable should you sue them. Contact an attorney . . . . or the lounge. Both are good.

Sure they didn't disclose it but it very well could have been ignorance on the guy doing the inspection. Saw the carfax was clean and it was a 2011 newer car, nothing to suggest he'd need to look at it extremely close to find and discover something that was begin covered up.

Dealer realized their mistake and are trying to fix the issue. Why contact an attorney? The dealer seems to be doing their part very fairly.

Ya they tried to get me to pay like 30 dollars more a month but I told them I couldn't afford it so in only going to be paying about 8 dollars more a month for a car with 30k less miles and a year newer... Thanks for the advice.. The attorney deal would probably cost the difference of the 480 dollars in payments or more so I guess I'll just take the newer car

CarFax is useless because they only report accidents that have been reported to them.

Is ignorance a valid legal defense? I don't know.

Seriously, it's a guide but not always accurate. A good mechanic is needed for the next car. You need to have it inspected by a person you trust and not affiliated with the dealership. The dealer could have made an honest mistake and it appears they are trying to rectify it. Or they tried to pull a fast one and got caught. Either way they seem willing to work with you. You can always add back-up sensors after market. Unfortunately I would not recommend after market sun roofs or color changes. Can your wife live with the color and no sun roof?

Florida Lemon Laws do not apply to defects caused by accidents, neglect, abuse, modification, or alteration by persons other than the manufacturer or its authorized service agent - typically an authorized dealer.

If the dealer is an authorized agent then it looks like you have some options.
