Mine came banded shut with 3 white nylon straps I had to cut off before I could even get the plastic case out of the box...and 1 battery was on the drill and had a charge in it.
Mine came banded too and the battery was installed like everyone else mentioned and had power. But it did feel like someone previously opened it. One of the ears on the paper box was folded in, like someone had taken it out and put it back in. There was like a piece of plastic under the flashlight, which I would think would surround the flashlight. The drill had some kind of a smudge of dirt or something on the rubber around the area where the hand goes. There was also a small scratch on the serial number sticker. I don't see any sign of dust (from drilling) on the drill, which I would expect if had been used. So either someone took mine out to look at it or they had really clumsy inspectors with dirt on their hands. Either way I am keeping it, since there are none left in my area. Worst case, I'll have to use the warranty.

How do you guys think this compares to the Hitachi? I'm not going to use the hammer function. Still have the Hitachi on hold at another Lowes but it's a pretty long drive to get there.
