Details: The Toyota economic loss settlement will resolve a massive consolidated class action (In Re: Toyota Motor Corp. Unintended Acceleration Marketing, Sales Practices and Products Liability Litigation) that accuses Toyota of selling millions of Toyota, Scion and Lexus vehicles with defective electronic throttle control systems (“ETCS”). This alleged defect has caused some of these vehicles to experience sudden and unintended acceleration, resulting in a significant decline in value of these vehicles. The case does not involve claims of personal injury.


If you currently or previously own(ed), lease(d), purchased or insured an eligible Toyota, Scion or Lexus vehicle model, you can receive one of the following benefits from the class action lawsuit settlement if it is approved:

Free Brake Override Installation: The brake override system will automatically reduce engine power when the brake pedal and the accelerator pedal are applied simultaneously under certain driving conditions.

Cash Payment (in lieu of Brake Override System): If you sold a Subject Vehicle during the following applicable periods, you can claim a cash payment of between $37.50 and $125, depending on the year of the vehicle, date of sale and the number of claims made. The only way to receive a cash payment is to submit a claim by July 29, 2013.


Class Members eligible to receive this cash payment include any one who:

(a) sold a Subject Vehicle during the period September 1, 2009 to December 31, 2010, inclusive;
(b) returned a Subject Vehicle before the lease termination date during the period September 1, 2009 to December 31, 2010, inclusive; or
(c) insured and/or guaranteed the residual value of a Subject Vehicle as of September 1, 2009, and with respect to such Subject Vehicle, thereafter either made payment to an insured, or sold the Subject Vehicle, provided such payment or sale was made by a Residual Value Insurer on or before December 31, 2010; or
(d) returned a leased Subject Vehicle before the lease termination date after having reported an alleged unintended acceleration event(s) to Toyota, an authorized Toyota Dealer or the National Highway Traffic Safety Administration (“NHTSA”), before December 1, 2012; or
(e) had a Subject Vehicle that was declared a total loss by an insurer during the period from September 1, 2009 to December 31, 2010, inclusive.

A Fairness Hearing will be held on June 14, 2013.

If you try to do it without the pin# on the postcard, it will direct you to call their 800 number. Just tried to call, and there were 28 people ahead of me. Crap.

Sold my car in 2012 and I don't qualify for this class action even though the car qualified. WTF.

Toyota Corollas 1998 - 2003 had cheap rings & a subset started burning a lot of oil. Even when they were still under warranty, Toyota would tell owners burning 1 quart per 1,000 miles was normal, and thus refused to do anything to address the problems. Many didn't start burning copious amounts of oil until out of warranty. While it was not a huge percentage of cars, the problem was due to Toyota cutting costs & using cheaper rings in the cars.
This is Toyota's modus operandi: deny any responsibility & refuse to fix the problem. Blame the customer (with the oil burning, Toyota regularly would accuse the owner of not changing the oil regularly, or not using the correct oil. Even when a customer had complete oil change records disproving Toyota's claims, Toyota still would do nothing.
The difference with the brakes is that BRAKE FAILURE HAS THE POTENTIAL TO KILL PEOPLE and it was only Toyota faced these lawsuits did Toyota take any action to address the problem. A lot of people have no problems with their Toyotas, but if you do have a problem, don't expect Toyota to be quick to admit any fault. Honda has a much better track record when it comes to customer care (as well as manufactures better designed cars without the serious problems seen with Toyota).

in my case, I sold on may-june of 2009, I think I also got disqualified since it's from sept 09..i think...WTF as well

You don't need the post card. my car qualified for the settlement too and I didn't even receive a post card. Go to their website, select 'No postcard was received' and file a claim with your VIN and vehicle details. It will still go through. Do it right now as today's the last day.

yes, there's a long wait. However at some point in the call, you will be directed to leave a call back number. I left mine a week ago and the call was returned on Saturday by a Rep, who was friendly enough and walked me through the process as I ad not received a post card. I was all the more keen on filing this as I had to sell my 2008 Prius at a steel loss after it took off while coming to a stop in a parking lot in June 2009. It won't help you today if they return your call a week later - just use the same instructions I provided above

I bought a used 2005 lexus and when i entered the VIN it says this:

"Our records indicate that the VIN you provided is a Subject Vehicle. You should receive a postcard no later than the second week of April. If you have not received a postcard with a Claim ID and PIN by then, please contact us at info@toyotaelsettlement or by calling (877) 283-0507. Thank you."

I would also prefer to get break override system....can i get it? whats the procedure to get it?

I was recently looking for a new car and I can't count how many cars had "new breaks". Would have never thought that a newly broken car was a selling point.

And the best brake override system is already in your car - it's called neutral
