Details: The Toyota economic loss settlement will resolve a massive consolidated class action (In Re: Toyota Motor Corp. Unintended Acceleration Marketing, Sales Practices and Products Liability Litigation) that accuses Toyota of selling millions of Toyota, Scion and Lexus vehicles with defective electronic throttle control systems (“ETCS”). This alleged defect has caused some of these vehicles to experience sudden and unintended acceleration, resulting in a significant decline in value of these vehicles. The case does not involve claims of personal injury.


If you currently or previously own(ed), lease(d), purchased or insured an eligible Toyota, Scion or Lexus vehicle model, you can receive one of the following benefits from the class action lawsuit settlement if it is approved:

Free Brake Override Installation: The brake override system will automatically reduce engine power when the brake pedal and the accelerator pedal are applied simultaneously under certain driving conditions.

Cash Payment (in lieu of Brake Override System): If you sold a Subject Vehicle during the following applicable periods, you can claim a cash payment of between $37.50 and $125, depending on the year of the vehicle, date of sale and the number of claims made. The only way to receive a cash payment is to submit a claim by July 29, 2013.


Class Members eligible to receive this cash payment include any one who:

(a) sold a Subject Vehicle during the period September 1, 2009 to December 31, 2010, inclusive;
(b) returned a Subject Vehicle before the lease termination date during the period September 1, 2009 to December 31, 2010, inclusive; or
(c) insured and/or guaranteed the residual value of a Subject Vehicle as of September 1, 2009, and with respect to such Subject Vehicle, thereafter either made payment to an insured, or sold the Subject Vehicle, provided such payment or sale was made by a Residual Value Insurer on or before December 31, 2010; or
(d) returned a leased Subject Vehicle before the lease termination date after having reported an alleged unintended acceleration event(s) to Toyota, an authorized Toyota Dealer or the National Highway Traffic Safety Administration (“NHTSA”), before December 1, 2012; or
(e) had a Subject Vehicle that was declared a total loss by an insurer during the period from September 1, 2009 to December 31, 2010, inclusive.

A Fairness Hearing will be held on June 14, 2013.

Ahh I remember getting a postcard and then I think I lost it. Thanks so much for posting this. Toyota will now send me a check (soon I hope) for 125.00!

naturally, I see this today, after it expires. Don't recall getting a postcard. Have a 2006 4Runner.

I just realized today was the 30th and I submitted mine today as well. Website is still up and running. It's worth a try. If I don't get the money that would really suck, but if I do then I'm sure it will help put food in my kids mouths.

It is still accepting the claim, after filing it says:
Based on the information you gave us, your allowed loss is $125.00
Hopefully gets this after the deadline passed away.

My 2001 camry's brake sux. Got into an rear ended a car that parked on the expressway. Those brakes should be recalled.

I called the phone number yesterday 7/30 (a day late) and there was only a wait of 6, so when I spoke to the person on the phone, she said that there was no guarantee that I would be included in the settlement since I was a day late, but she issued me a ID number and a PIN and told me to go online and enter it into the File a Claim page. I completed it all and we'll see if it results in a $125 check or bupkis...I never received a postcard as far as I recall, so thanks to OP and SD for posting this. Too bad I didn't see it until the day after the deadline but that's on me.

I completely forgot about this and just entered my info on the website today.

Kept going and supposedly we qualify for $125. That would be great if if comes. Thanks OP!

They kept telling us no problems, must be the driver(s).After it became know there were problems they took out our floor mats, that didn't work so they did something to the acc. pedal. Still did not work, we were getting really scared to drive it so we sold for a big loss! Say what you want but I am GLAD the lawyers are on top of this, we stand to get $3,300 back, not enough to cover our loss but better than nothingwoot

This lawsuit is absolutely ridiculous! The NTSB hired NASA rocket scientists to investigate the issue and found NO problems with the vehicles and deemed each case operator error. Yet everyone wants to sue, it makes me sick to see what this country has become!
