That may very well be, however sometimes settling is easier than court. And class action generally will take to court (if judge allows) unless they get a good settlement

That being said, I love my fitbit and I see no faults with it at all. It's a fantastic accessory and depending on your lifestyle I'd highly recommend

Just got my open box Charge HR XL from a seller on eBay last week for $79.99. It was like brand new in the original box. It does count steps as im moving my arms when im sitting but it seems to be very consistent in that it Shows about the same amount of steps each day. I am very impressed with how well it tracks sleep. It litterally gets the time you lay down and wake up within the minute! The heart rate sensor seems to be fairly accurate except for when I increase my activity and my heart rate goes up, then it takes the fitbit a while to catch up to my faster heart rate. Overall though i am very satisfied with my charge hr. I just dont think it is worth more than i paid.
