AT&T unlimited price hike - how to cancel contract w/ no ETF but stay month to month?

Has anyone on AT&T unlimited been able to get them to terminate their contract but stay month to month? I know people have been able to do this with other contract changes that allow for waived ETF? I tried chat, even escalated to a supervisor, and this was the outcome:

ME : ok, so if I cancel the entire line AT&T will waive the activation fee, but if I want to stay a customer but cancel the contract, that's not an option. Is that the right understanding?

Philip - Supervisor : We can not remove the contract unless the line is canceled.
Has anyone been able to do what I'm trying to and been successful? Any tips?

No advice on staying on at&t, but have you considered moving to an at&t compatible mvno like cricket?

i have. I think I'm still coming out ahead with the AT&T plan I have now, but I want to go month-to-month with them in case t-mo or VZ pop up with some killer promo and I decide to jump ship.

You'd have to read the terms of whatever contract your signed carefully...

Generally, this sort of thing would fall into the category of they breached the contract by changing your rate potentially allowing you to escape the etf. I haven't had a contract with at&t in a while, but it wouldn't surprise me if they have worked some additional clauses in to allow them to recover the cost of a smartphone. As to your chat, that's going to come down to saying the right things along the lines of they breached your the contract.

Most people would switch to a different carrier or mvno, keeping your phone number can be the tricky part. You should probably start by acquiring a copy of your current contract. You might end up porting your line out and informing them that you believe they breached the contract by raising your rates via certified mail. Read contract carefully and see what happens, consider arbitration / small claims court if appropriate.

Typically you have a small window of time (~30 days) to complain about the materially adverse change. If you use other methods of contact, always followup via certified mail and reference other communication in your letter.

File a BBB report, don't even waste time with CS reps. This will at least escalate the issue to a higher tier of CS service. If that doesn't work then I'd jump ship to Tmobile or someone who is still comping ETF fees.

I'm not sure the BBB is going to do much here. AT&T is willing to waive the ETF, it's just with the condition that the op close the service. That the op wants to stay on under the new terms sort of hurts their case that this a materially adverse change.

Well, objectively speaking it is definitely materially adverse.... Just in this case not adverse enough to be worse than switching. But I do see the point you're making.

What happens under the scenario where I have the unlimited data plan and I just bought an iPhone 6s via the old subsidized model in December 2015. If they waive the ETF and I leave AT&T how will they handle the phone I paid $299 for? I assume I'm not walking away with the phone for what I've already paid. Or am I?

You are, as long as you upgraded it before the news of no more subsidies became public. I don't remember when that happened.

If it was after, the contract was amended already with the new terms so you'll be liable for ETF
