Lucky guy. Looking for one but my Staples doesn't even sell them. Pretty much zero on anything related to Surface.

do they work on the sp3?

Yes it works on an SP3. The added friction makes it nicer to write with and I haven't had the same issues with the pen cutting out as I had with the SP3 pen. Probably not worth paying the full $50-60 unless you use it a lot.

Extremely YMMV as this is limited to stores that carried the SP3 but not the SP4.

Based off my visit to my local Staples, my assessment is this: they don't have Surface Pro's on the floor anymore, just on the website. I think a good way to check to see if this clearance deal is POSSIBLY available to you is to see if your local staples carries other Surface Pro accessories. If you look at the OP's pic, you will see the Pen is hanging next to the surface pro power adapter. If you view the Pen on Staples website, you will find no link to search local staples for pickup. If you instead view the power adapter on Staples website, you will get an option to search local stores. You will of course find limited availability, but at least it will give you an idea of locations that still carry Surface Pro official gear.

edit:
This trick successfully worked for the Staples near my parents (160 miles away). Staples site said they had a couple Surface Pro power supplies in stock so I called them. They do in fact have the Pen, unfortunately not on clearance. Full price, $59.99. So, yes, very YMMV.
