Family Dollar has agreed to pay $1.5 million to settle a class action lawsuit that accused the discount retailer of violating the Telephone Consumer Protection Act by texting customers without prior express written consent.

Lead plaintiff Reginald Moore of Missouri filed the Family Dollar class action lawsuit after allegedly receiving numerous text spam messages on his cell phone regarding sale items.

Under the terms of the class action settlement, Class Members will receive a portion of the $1.5 million. The estimated settlement pay-out is valued at $45 in cash as well as a Family Dollar $30 gift card for each Class Member.

Individuals who want to object or opt-out of the Family Dollar settlement must do so by May 18, 2016.

Family Dollar settlement Class Members include all U.S. residents who were sent text spam from the company as part of a subscription-based program between Oct. 16, 2013 and Mar. 7, 2016

$75 – $500

Class Members are estimated to receive a cash pay-out of $45 as well as a Family Dollar gift card valued at $30. Depending on the number of valid Claim Forms, Class Members may receive up to $300 in cash as well as a Family Dollar gift card of $200.

Class Members do not need to provide proof of purchase but they must submit a Claim Form no later than June 3, 2016 to receive benefits from this TCPA settlement.

I still haven't gotten my Tuna one from Starkist and I swear that one was almost a year ago!

Poor dollar store. They are a dollar store for godsakes-like a charity business. You feel bad that things are so cheap, you buy something even if you dont need it. They are not ripping the customers off and these lawyers should let them alone.

Thank you for sharing your thoughts.

I do have two related items I'd like to share:
  1. Family Dollar is a subsidiary of Dollar Tree, Inc., which has a revenue of $8.6 billion as of 2015.
  2. Consumers are able to take legal actions against companies - whether it's a major corporation or a small business - if the company has done something that isn't lawful.
I do not want to go into arguments, but figured the facts I stated above may be informative.

By the way, I'm guessing records will be checked for the phone numbers targeted, unless they were dolts and had this contracted out to a third party that just spammed every number possible.

nice posting but unfortunately the only ones that really win are the lawyers--you get $45 and a $30 gift card and they get hundreds of thousands

That's good of you. People complain about the scummy lawyers taking so much, but probably most people on this site apply for refunds from classes for things they weren't involved in, which reduces payments to those who actually deserve the settlement. Classy people.

haha. Ethically, some may agree with you. I personally only register for class action settlements when I am actually affected, not only because I personally think it's unethical of me to do it otherwise, but also because of legality reasons. Taking advantage of these settlements may result in legal actions.
