open only to legal residents of the fifty (50) United States (including District of Columbia) who are at least eighteen (18) years old at the time of entry, a TracFone customer

begins on September 13, 2016 at 12:00 a.m. Eastern Time ("ET") and ends on November 11, 2016 at 11:59 p.m. ET

Limit: Each entrant may enter/play one (1) time per day

Prizes:
Sweepstakes Prize: ONE (1) GRAND PRIZE: $20,000 check. Approximate Retail Value
("ARV"): $20,000. Odds of winning the Sweepstakes Prize depend on the number of eligible entries received during the Promotion Period.

Instant Win Game Prizes: ONE THOUSAND TWO HUNDRED (1,200) FIRST PRIZES (twenty (20) per calendar day): $20 gift card to a retailer of winner's choice selected from a list of Sponsor provided retailers, including Visa, upon prize claim. ARV: $20.

TOTAL ARV OF ALL PRIZES: $44,000.00.

My question is based on the legal hurdle that sponsors must accept if they hold sweepstakes in this country. Unless it is deemed a contest of skill, a fee or purchase cannot be required to enter or win. It appears that this sweeps violates that condition. Am I wrong?

A childish remark like that doesn't deserve answering but since you obviously brought up jealousy, I'd like to know if you get this upset when a credit card company or bank has an instant win game you aren't eligible to participate in because you aren't a customer? Move on to another instant win game to try your luck ! A sour grapes attitude will get you not get you a win.

I asked a simple question about if (or not) Tracfone's sweeps is a lottery. They require a registered account to enter. The only way to get an account is with a Tracfone-assigned phone number. The only way to get that number is by purchasing a phone from them. All of this is stated clearly on their website. Despite what the rules specify, they are requiring a purchase to enter.

You took this personal. My complaint is not with you, but with Tracfone. Calling someone jealous and childish should be beneath you as a longtime member of this forum. A "sour grapes attitude", as you called it, would be evident if I claimed that the prizes are not worth having because I cannot enter to win one. That's not at all my point. Before you use an analogy, please be sure that you understand its proper application.

If a credit card company or bank holds an instant win game in the USA, they must, by law, make it available to those who are not their customers. I would wager that you cannot find one that did not. Please do your best to provide a single example.

You're not required to make a purchase to play but the sweepstakes is only open to existing customers though - its a minor difference, but a legal one.

Plenty of companies do similar things... the act of entering costs nothing.

I did see that "already a customer" stipulation. Maybe that is a loophole to get around the law.

There are the Visa sweeps and the banks that give you an entry every time you use the ATM, but the ones I have seen always offer some sort of mail-in or online method for non-customers.

I've entered the AARP ones, but those don't require membership.

This Tracfone one is the first I recall seeing with that kind of stipulation.

The bank ones have to have a mail in because the physical act of entering requires spending money - without the amoe on those, it would be considered a lottery.

There are a bunch that require a membership to enter... a few examples are leave a review to win, answer the survey about your purchase to win, etc. (although some of those do have an amoe as well) https://www.myrmgmortgage.ca/RulesRegs.aspx is another example of sweepstakes with similar language about having an existing mortgage in order to enter.

It boils down to a design/marketing choice of the sweepstakes sponsor. If a company wants to have entries open to the "general public" they can (and most do to try to lure new customers). If not, they don't have to (as long as you don't have to take part in a financial transaction as part of the act of entering to win... for instance to reward only existing customers like this one).

There are TONS of wacky little rules relating to contests, sweeps, etc. If Florida residents are allowed to enter, the entire prize must be secured by guaranteed 3rd party bond. Its the only state in the country that does that and its why FL is excluded from some sweepstakes by companies that don't want to front the prize money.

I'm with jobey on this one. I had a tracfone and it was "magically lost" --- It's $4.99 for a tracfone (I guess with the first month service?) and do agree an alternate method should be and usually is standards especially from Hello World!

Not to mention the hundreds of music videos on YouTube what's stopping someone from exploiting it? As if we would ~ It's a simple fact that whoever is entering should have a "Trac Product" although from the replies in this thread I'm starting to think it's a bullshit contest to begin with so many terms and conditions that it's impossible to actually win something and even if you do, you're probably not gonna get it because it's not being actively monitored with the other 30ish promotions going on

Could you post an image of the confirmation email? Were you immediately emailed a code or are you waiting for a physical card?
you get an email confirming you won, with 2 codes to put in , then you give name and mailing info,and choose from what kinda gift card you want. It is a mailed card no matter what card you choose, i picked amazon
