I'm not suing for selling for charity.

I'm taking action because they purposely advertised specific items, then mislead people, by not stocking reasonable amounts of each product, then they made it impossible for me to purchase the items, all the while looking at their website and advertisements for 8 hours.

On Monday I will be sending them a 93A letter to their registered agent for service of process.

93A is for small claims up to $2,000.

It is a mechanism for people to utilize the judicial system without going through a trial or paying court fees.

Once I send the letter, they must respond within 30 days either denying the claim or offering a reasonable settlement.

If enough people send these in, maybe they will notice. It's pretty much unenforceable since they moved out of Massachusetts, but it's more the principle than the actual compensation.

Here is a vendor offering a product at a price knowing that the amount of stock that is available is unreasonable. All the while, I'm sitting on their website for 8 hours. Bait and switch.

Aside from the legal costs, any attorney who files a claim under such dubious circumstances would be sure to face sanctions and possible punishment from the bar. Good luck.

On a second note, I wouldn't talk about your legal options and what you plan on doing on message boards. Sounds to me like you may be a law student, someone who thinks they know about law, or a newly minted MA attorney trying to prove a point. Talking the way you do on an open community could be considered unauthorized practice of law. Cover your ass on message boards.

Actually there is quite a bit of case law regarding these types of situations.

Here is a vendor offering a product at a price knowing that the amount of stock that is available is unreasonable. All the while, I'm sitting on their website for 8 hours. Bait and switch.

For those recent law graduates, you may remember the case regarding the advertisement of a fur coat.

However, I would like to direct your attention to another case from the 1960s. JellyStone National Park -v- Yogi and the Pic-A-Nic Basket. Clearly a precedent was set in that case which supercedes the Fur Coat Advert case which occurred decades earlier.

I guess with the AIO the webcast was worth my ten hours, but I feel pretty bad for people who came away with nothing. It was A LOT easier to get through early in the day.

phrainq
11-28-2008, 07:20 PM
I'm not suing for selling for charity.

I'm taking action because they purposely advertised specific items, then mislead people, by not stocking reasonable amounts of each product, then they made it impossible for me to purchase the items, all the while looking at their website and advertisements for 8 hours.

On Monday I will be sending them a 93A letter to their registered agent for service of process.

However, I would like to direct your attention to another case from the 1960s. JellyStone National Park -v- Yogi and the Pic-A-Nic Basket. Clearly a precedent was set in that case which supercedes the Fur Coat Advert case which occurred decades earlier.

I find it amazing that Compusa/Tigerdirect were able to get thousands of people to view their website for hours upon hours.

Think about how valuable it is to get thousands of tech geeks to view and browse your website while waiting for these "deals" to come up, when in reality there are no "deals" at all.

They had thousand of people staring aimlessly at their website for hours.

This is probably the greatest advertisement scam/bait and switch that I have ever seen.

Simple: They have X number that they bought from Mitsubishi that they are selling and Y number that Mitsubishi donated specifically for this purpose. They are out of that Y number.
