I was not sure how to classify this. It is not really a "deal" but more a "heads up" about a class action settlement. If you used your credit card in a Tuesday Morning store in California between July 30, 2007 through July 31, 2009, you may be a member of the class. Long story short: Tuesday Morning collected personal information on credit card receipts - and as part of the proposed settlement, affected people will get at $10 certificate to spend in their store. I shop there regularly, so received an email notifying me that I have been identifed as a member of the class and will receive the certificate.

So here's the "heads up" part" If you think you are a member of the class, but did not receive the notification my email, here is what you need to know:


If you did not receive this notice by e-mail, but are a member of the Class, you are still entitled to all of the benefits under the proposed settlement. To obtain a Merchandise Certificate, you can visit any Tuesday Morning retail store location in California and request a Claim Form; or you may go to http://AndersonVsTuesdayMorning.simpluris.net and either fill out or download a claim form. Class Members who did not receive this notice by mail must complete the Claim Form and deliver it to the Claims Administrator no later than December 23, 2009. Mail the Claim Form to:

If you did not receive this notice by mail and you do not submit a valid and timely Claim Form, you shall not receive a Merchandise Certificate. The date of delivery is deemed to be: (1) the date the form is deposited in the U.S. Mail, postage pre-paid, as evidenced by the postmark; (2) the date the form is deposited with an overnight letter carrier guaranteeing delivery within two business days; or (3) the date of personal delivery of the form to the Claims Administrator.

If the Claims Administrator determines from the information contained on the Claim Form that you are a Class Member, you will receive the benefits of the settlement provided to Class Members if the Court approves the settlement.

To Have Personal Information Removed Tuesday Morning's Records. If you wish, you may request that your personal information (i.e. address, telephone number and/or e-mail address) be removed from Tuesday Morning's databases by marking the box on the Claim Form requesting the removal of such information and sending the Claim Form to the Claims Administrator at the above-referenced address.
