Now, I may have the definition of sexual harassment wrong. But, isn't sexual harassment between one person and another person of authority--i.e. someone's boss, supervisor, superior? I don't think it applies to just random ppl and random locations. Any sexual "talk" could be inappropriate and offensive. However, it isn't "sexual harassment".
If that was the case, then anyone could try to sue another person who was hitting on them at any bar, club, social setting, or anywhere!
OP,
At best, your friend could be fired for inappropriateness with customers. Honestly, I think it's a case where the customer is trying to get something out of this. Because, as a customer, she could just stop going to that place if a nail person tried to hit on her and said things that were offensive to her.

My thinking as well. Unless he actually DID something like touch her inappropriately, I dont see where it is a matter for police. Now her coming back with a couple of guys to harass or intimidate may be another issue.
The problem the OPs "friend" is going to have is with management of the salon.

Example of SH (Sexual Harrassment) on a UC Campus...
At UC Davis...if for instance you are construction worker, just doing your job, etc and one of the students thinks you have leered at you for more then 3 seconds, you and the company you work for could be held liable for SH.
So just checking out the hawt chick (or ugly ones for that matter) can get you sued and your employer kicked off a UC Campus.:bulb:
So the Worker would not be in a position of superior authority to the student.

Well, I think there are specifics with the above case that can make it somewhat like SH. First, it concerns a student on campus. Secondly, the construction worker is technically a school employee......although, he's more like an independent contractor. And so, it could be considered SH because the school has created an uncomfortable situation for its student who has to be at the school.
However, let's say it's a construction worker who was leering at some random person (not student) at his work site. That would NOT be SH.
I'm not saying that SH only applies with employee and employers/superiors. It can occur with classmates and teachers, fellow classmates, and TA's too. But certainly, it wouldn't apply with business employee and customer when it's just inappropriate talk.

When it occurs in a public place it's called Public Accommodation Discrimination. You may not, at any establishment discriminate against customers on the basis (state and federal law) of gender, race, religion, or disability. So if you work at a movie theater and slap a patron on the butt or make lewd remarks to her that's harassment on the basis of gender. It could be grounds for a lawsuit against the theater and she can sue you personally in civil court.
:iagree: actual detail might help..
:iagree: Witnesses? What went down? It's a civil case so the police should not be called, as someone already noted, unless there is some physical threat made or something. Even then, you go to the court and request an TRO which has nothing to do with the police.

Sure, but has anyone won any lawsuits and cash awards for such cases? I would think that if the cases were extreme, it would be possible. But, innocent flirtation and sexual innuendo at a nail salon between the nail person and customer wouldn't be enough for such lawsuits, right?
As far as your example above, of course slapping her on the butt is really bad. So, let's not even go that route. And as far as grounds for a lawsuit, any person can sue for any reason. But, will that person prevail in court? That's the key.

Yes! Why your tax dollars go to fund a completely dysfunctional entity called the Human Rights Commission or variations. They assist thousands of people complaining of housing discrimination and public accommodation discrimination every year. If the company chooses to mediate with you the HRC can get you around $10,000 and you wont even have to step foot in court or hire a lawyer. But because people abuse the system they are overwhelmed with complaints which take about 2 years on average to get through. :facepalm2:
It doesn't need to be extreme (whatever that means). In civil court you only need to prove that it's more likely than not that the defendant did the deed. But it helps to have witnesses, to show it's happened before, to provide the court with medical bills.

I can tell you that I've worked in environments where there are A LOT of gay guys around me. NEVER has a gay man come on to me or done anything to make me feel uncomfortable. Most gay men know their boundaries. And, despite the fear that many homophobic men have, gay men aren't actively out there trying to turn straight men gay! They usually know who's gay and they won't hit on you if you're straight.

I'm 5'8" in height, not sure what the Asian avg. is, but I am willing to assume I am above it. I believe it is 5'6", but I can be wrong. Also has for my "size", lets just say I am bigger than the normal Asian male, don't ask me how I know (gym locker rooms, my school is 50% Asian, you are bound to see things that you do not want to, and for what it's worth, is it bad to laugh when you see something small?), and I am not gay/homosexual in anyway. As for driving, I do not believe I am bad, have not gotten any tickets or anything I keep within the 10mph buffer, so if its 65 I got around 73.
