JANESVILLE, Wis. — A driver who was stopped for speeding and tested over the legal limit for blood-alcohol content, but was not arrested, was killed less than three hours later Monday when his car hit a tree, according to police.
Janesville police records indicate that Jason Stacy, 29, was seen speeding and driving erratically downtown shortly after 1 a.m.
According to an analysis of police records by WISC-TV in Madison, Stacy was stopped and given a Breathalyzer test that indicated a blood-alcohol level of 0.12 percent. The legal limit in Wisconsin is 0.08.
Stacy was ticketed for imprudent speed and failing to stay in the center of his lane. The officer didn't arrest Stacy but did prevent him from driving until a friend picked him up, the television station reported.
Around 3:45 a.m., Stacy's car hit a tree and burst into flames, deputies said. Stacy, who was alone and not wearing a seatbelt, was found about 50 feet away.
Janesville police declined to comment. The Rock County Sheriff's Department said it is investigating.

LOS ANGELES — A man trying to kill himself and his girlfriend by stopping a car on railroad tracks died Monday when a commuter train crashed into the vehicle, police said. The girlfriend survived.
The man drove the car in front of a group of other vehicles stopped at a railroad crossing in the San Fernando Valley neighborhood of Sunland, Officer Mike Lopez said.
The driver, who was seen arguing with his girlfriend, parked the car on the tracks moments before a northbound Metrolink train crossed the road, Lopez said.
The train hit the rear passenger side of the car, spinning it around and ejecting the driver. The girlfriend was taken to the hospital, where she was later upgraded to stable condition, Lopez said.
Officials had earlier said they believed the man was trying to kill his girlfriend but fled the car before the train hit, only to be crushed by the car. They later revised their account because of new information.
There were no injuries on the train, which carried 132 passengers and crew members, said Denise Tyrrell, a Metrolink spokeswoman. The train had superficial damage.
"The train to your car is like your car to a soda pop can. It's just not going to be a fair fight," Tyrrell said.

Innocent people killed by drunk drivers are still dead regardless of whether the drunk had .08 or .32 bac.

He made a conscious decision to drink and drive and accepted the consequences. I will be honest, I get a sick joy out of hearing stories where drunk drivers actually kill themselves instead of others. Probably has a lot to do with my driver's ed class in highschool when they showed the actual footage of a completely burned body of a 8 year old girl who got trapped and killed by burning alive in a burning car hit by a drunk driver. By the way, the drunk driver survived literally unharmed. I had a close friend in highschool and an uncle I was close to die in drunken driving accidents where they were drunk and fortunately hurt no one else. While I was sad to lose them, I felt little sympathy for them and more for their families.

A man with a record for burglary was killed Thursday morning by the blades of an industrial fan as he tried to wriggle out of a warehouse he had apparently broken into overnight, police said.
As the intruder was squeezing past the fan to make his getaway, he managed to kick the on/off switch into the ''on'' position -- with predictable results.
''He did it to himself,'' said Napier Velazquez, a Miami police spokesman.
The warehouse at 7124 NW Second Ct. belongs to Marantha Used Clothing, which takes in used clothes, packages them in bundles and ships them to Haiti. In addition to old clothes, the building is filled with used ceiling fans, tennis rackets and battered bicycle helmets.
''He was stealing just junk,'' said Lt. Bill Schwartz of the Miami Police Department.
The man was discovered at 8:30 am. by Anicette Pacouloute, a worker at the warehouse who was opening the building. An employee for just three days, she spotted the man's legs dangling from the opening that encases the fan and called 911.
''I'm shocked. I'm distraught. I've never seen anything like this,'' she said.
The name of the victim, a man in his 40s, was not immediately released, although Schwartz called him a ''known burglar.'' He entered the warehouse by prying apart some metal bars sometime after Pacouloute closed up shop at 7 p.m. Wednesday.
The fan, which caught the man around the rib cage area, ventilates the concrete building that sits amid a row of industrial structures.
One of the blades of the six-bladed fan was badly bent after the encounter.

at the end, in order to obtain a decapitation, they used an industrial fan with sharpened edges on the blades. Their conclusion was that death would likely occur by bludgeoning (as it did here) rather than decapitation.

BAYTOWN, Texas - Six teenagers in a stolen car slammed into a freight train parked at a railroad crossing early Thursday, killing four of them and leaving another in critical condition, authorities said.
The impact tore the roof off their Jeep Cherokee as it skidded under a tanker before winding up on the other side of the tracks, said Lt. John Martin, a spokesman for the Harris County Sheriff's Department.
Authorities believe the 15-year-old driver didn't see the train until it was too late. The intersection was dark and didn't have a crossing gate or lights.
Three 14-year-olds and a 13-year-old, all seated in the back, were killed. The driver and a 15-year-old in the front passenger seat were airlifted to a Houston hospital, where the driver was in critical condition and the other was listed as stable.
"There were some short skid marks," Martin said. "It would appear the driver noticed the train immediately before impact, but not early enough to stop hitting the train."
The car was reported stolen shortly before the accident and did not belong to any family members of the passengers, Martin said. At least two of the victims were cousins, he said.
No identities were immediately released.

Two of Lopez's sons who live nearby said their father had been threatening for months to burn himself and his house. His wife was seeking a divorce and he didn't want to have to leave the house, the sons said. Lopez also had a history of mental illness, one of the sons said.
The police department began using Tasers, electronic stun guns designed to subdue violent suspects, in January 2004.

GRAND RAPIDS, Mich. - Bill Barnes says he was scratching off a losing $2 lottery ticket inside a gas station when he felt a hand slip into his front-left pants pocket, where he had $300 in cash.
He immediately grabbed the person's wrist with his left hand and started throwing punches with his right, landing six or seven blows before a store manager intervened.
"I guess he thought I was an easy mark," Barnes, 72, told The Grand Rapids Press for a story Tuesday.
He's anything but an easy mark: Barnes served in the Marines, was an accomplished Golden Gloves boxer and retired after 20 years as an iron worker.
Jesse Daniel Rae, the 27-year-old Newaygo County man accused of trying to pick Barnes' pocket, was arraigned Monday in Rockford District Court on one count of unarmed robbery, a 15-year felony.
Barnes said he had just withdrawn the money from a bank machine and put it in the pocket of his shorts before driving to the Marathon service station and Next Door Food Store in Comstock park, a Grand Rapids suburb.
He remembers noticing a patron acting suspiciously, asking the price of different brands of cigarettes and other items. While turned away, Barnes felt the hand in his pocket, so he took action.
"I guess I acted on instinct," he said.
Kent County sheriff's deputies said the store manager quickly came around the counter. The three of them struggled through the front door, where two witnesses said the manager slammed Rae to the ground and held him there.
"There was blood everywhere," said another manager on duty, Abby Ostrom, 25.
Barnes was a regional runner-up in Golden Gloves competition in the novice and open divisions before enlisting in the Marines in 1956.
He lived most of his adult life in Comstock Park with his wife, Patricia, before recently moving to Ottawa County. The couple have three children.
After retiring as an iron worker, he now works part-time as a starter at a golf course.
Barnes said he'd probably do the same thing again under the same circumstances, if for no other reason than what he would face back home.
"I wouldn't want my wife to give me hell for lettin' that guy get my money," he said with a smile.

I welcome others to include similar stories of the criminal or the crazy getting their just do, with the apparent victim getting the last laugh. These are the "feel good" stories I wish got more airplay.
My father use to love the stories he called "When Crazies take out Crazies". These would include the terrorist bomb maker who accidently detonated a bomb in his own house taking himself out before an innocent could get killed. I have likened it to the two instances I have personally witnessed when two people are backing out of spots and back into each other as they are both holding cell phones to their ears. I get such satisfaction from those instances! :lmao:

A 71-year-old former Marine opened fire on two robbers at a Subway Sandwich Shop in Plantation late Wednesday night, killing one and critically wounding the other.
According to Plantation police, two masked gunmen came into the shop at 1949 N. Pine Rd. just after 11 p.m.
There was a lone diner -- retired Marine John Lovell, who was finishing his meal.
After robbing the cashier, the two men attempted to shove the ex-Marine into a bathroom and rob him as well.
They got his money.
But then the ex-Marine pulled his handgun, opened fire, shooting one of the thieves in the head and chest and the other in the head.
When police arrived, they found one of the men in the shop. K-9 units found the other in the bushes of a nearby business.
They also found cash strewn around the front of the sandwich shop.
''There were fives and rolls of coins everywhere,'' said Detective Robert Rettig of the Plantation Police Department.
Both men were taken to Broward General Medical Center, where one, Donicio Arrindell, 22, of North Lauderdale died.
The other, 21-year-old Frederick Gadson of Fort Lauderdale, is in critical but stable condition.
The ex-Marine is not expected to be charged, authorities said.
''He was in fear for his life,'' Rettig said.
The restaurant was not open Thursday because the front window was shattered.

MIAMI-DADE COUNTY, Fla. -- A man who allegedly was fleeing police was attacked and killed by an alligator in a pond, Local 10 reported.
Miccosukee police, assisted by Sweetwater canine units, responded to a call on the Miccosukee Indian Reservation about vehicles being broken into.
Local 10's Todd Tongen said police captured one man, but another fled on foot and dove into a retention pond. Signs warned of the danger of live alligators in the pond behind the casino and hotel.
Eyewitnesses said they were shouting to the man to swim back to shore. When the man finally spotted the alligator, eyewitnesses said he screamed but then disappeared under the water.
The alligator and another smaller one were later trapped and brought to All American Gator in Pembroke Park.
Local 10 learned the larger alligator was well known on the reservation and employees had nicknamed it Poncho.
If an alligator either digests or kills a person it's a state law through Florida Fish and Wildlife that it be destroyed, so the alligator will be put in an incinerator or be buried, Tongen reported.
Wood said he's been told to keep the alligator in storage until the Miami-Dade medical examiner can inspect the reptile.
"Some gators have a nasty disposition and he was a nasty gator. He seemed to have no fear of people which indicates that he was fed," said Wood.
The body was recovered Friday by divers 50 feet below at the bottom of the lake.
Local 10 learned the man was bitten on the head several times. Miccosukee police issued a no comment statement when Local 10 inquired about the victim's identity.

The New York Times reports today on a group of five conservative authors suing the parent company of Regnery -- the conservative publishing dynasty -- over what they claim was the house's deprivation of royalties. This suit claims that Eagle Publishing, of which Regnery is a subsidiary:
“orchestrates and participates in a fraudulent, deceptively concealed and self-dealing scheme to divert book sales away from retail outlets and to wholly owned subsidiary organizations within the Eagle conglomerate.”

In Regnery’s case, according to the lawsuit, the publisher sells books to sister companies, including the Conservative Book Club, which then sells the books to members at discounted prices, “at, below or only marginally above its own cost of publication.” In the lawsuit the authors say they receive “little or no royalty” on these sales because their contracts specify that the publisher pays only 10 percent of the amount received by the publisher, minus costs — as opposed to 15 percent of the cover price — for the book.
This reminded me of a piece I wrote several months back about Karl Zinsmeister, currently President Bush's Chief Domestic Policy Advisor (whose ex post facto quote and resume-fixing earned the moninker "Zinsmeistering"). Two months previous to his hiring by the White House (where he replaced the kleptomaniac Claude Allen), Zinsmeister was fired from his position as Editor of the American Enterprise Institute's American Enterprise magazine, partly for his involvement in a similar scheme:
And so it was that AEI began buying Zinsmeister's books to give to new subscribers. The strategy, whichdebuted in 2003, was to lure people into subscribing through directmail by offering a free Zinsmeister book with their subscription. Granted, the situations are a bit different in that in Zinsmeister's case, he (as the writer) was making quite a good deal of money off of AEI through this arrangement, whereas in the Regnery case the writers claim to be getting screwed. I wonder if this latest incident will make some people think twice about market forces curing everything

GRAND RAPIDS – A thief in Grand Rapids got a little more than he bargained for when he tried to steal knives from the Meijer store, located at 1997 East Beltline in Grand Rapids.
Police say the thief tried to steal $300.00 worth of hunting knives by hiding them in his waistband. When the man tried to leave the store Meijer employees confronted him and a scuffle followed. Police say the man then fell and was stabbed by the knives in his waistband.
Meijer's Director of Public Relations, Frank Giuliano says, "The man was taken to the hospital, we are cooperating with the investigation by police."

I have no problem with people taking themselves out … I think many people have many good reasons to do so … I just wish folks would do it in ways which didn’t harm others.
As Fredrich Neitzsche says “if you cannot teach a man to fly, teach him to fall faster”.
I don’t think people should take suicide lightly—but I do believe in some cases it is the best thing for them and I think our prohibitions against it are perverse.
I really do believe in the adage "live free or die". I think living as though each day is our last day on this earth can spur us onto living the life we want to live. So many people get stalled in some miserable situation or some wretched nook and cranny-- I don't judge them-- but it is they and only they who give human life its questionable aspect. As Emerson says "man is a God in ruins".

An American senior citizen killed an alleged mugger with his bare hands, and his traveling companions aboard a tour bus fended off two other assailants in the Atlantic coast city of Limon, police said.
A retired member of the U.S. military aged about 70 put suspect Warner Segura in a head lock and broke his clavicle after the 20-year-old and two other men armed with a knife and gun held up their tour bus, Luis Hernandez, the police chief of Limon, 80 miles east of San Jose, said Thursday. Segura was later declared dead, apparently from asphyxiation.
The two other men fled when the 12 senior citizens started defending themselves during the Wednesday attack. Afterward, the tourists drove Segura to the Red Cross where he was declared dead. The Red Cross also treated one of the tourists for an anxiety attack, Hernandez said.
The tourists left on their Carnival cruise ship after the incident and Hernandez said authorities do not plan to press any charges against them.
"They were in their right to defend themselves after being held up," he said.
Hernandez said Segura had previous charges against him for assaults.
In a media statement, Miami, Fla.-based Carnival Cruise Lines said the Wednesday incident occurred during an outing at a Limon beach which a group of a dozen passengers had arranged on their own.
"According to witnesses, while sightseeing at a local beach, the group of guests were approached by three assailants, one of whom was armed," the statement said.
"The victims struggled with the armed perpetrator, and were able to disarm him. During this process, the gunman's two accomplices fled the scene. In the course of disarming and restraining the assailant, he died from apparent asphyxiation."
Neither the Costa Rican police nor Carnival identified the man involved in the struggle with the mugger.
The cruise line said the guests were questioned by local law enforcement and then returned to the ship. The ship's departure from Limon was slightly delayed to await their return.
"All of the guests involved, who had booked the cruise together as a group, have opted to continue with their vacation plans. Carnival is providing full support and assistance to the guests," according to the statement.
The ship, The Carnival Liberty, continued on its scheduled itinerary, with a port call scheduled in Colon, Panama.

KOKOMO, Ind. — A man accidentally shot himself in the groin as he was robbing a convenience store, police said.
A clerk told police a man carrying a semiautomatic handgun entered the Village Pantry Tuesday morning demanding cash and a pack of cigarettes. The clerk put the cash in a bag and as she turned to get the cigarettes, she heard the gun discharge.
Surveillance video shows the man shooting himself as he placed the gun in the waistband of his pants, police said. The clerk wasn't injured.
A short time later, police found 25-year-old Derrick Kosch at a home with a gunshot wound to his right testicle and lower left leg. He was expected to have surgery at a hospital.
Police plan to charge him with armed robbery.

Xaviein Bendross, 28, was one of three men killed in a drive-by shooting Saturday at an intersection in Miami's crime-ridden Liberty City neighborhood, Miami-Dade County police said Monday. A fourth man in their car remains hospitalized in critical condition. No arrests have been made.
Bendross was on probation for his role in the death of 39-year-old Tosca Dieperink at a nearby gas station.
"I think it's ironic - tragedy begets tragedy," said Miami-Dade police Sgt. Anne Bogen, who helped investigate the 1996 case. "It's terrible anytime anyone gets killed. It was tragic for the Dieperink family and I'm sure it's tragic for the Bendross family."
Dieperink was shot in the chest while sitting in a rental car. She and her husband had pulled into the gas station seeking directions to a mall. The slaying rattled Florida's tourism industry, which at the time was still struggling to recover from the slayings of 10 foreigners in the state in 1992 and 1993.
Two young men pleaded guilty to second-degree murder and are still serving decades-long prison sentences. Bendross, then 16, was the driver of their getaway car and pleaded guilty to a robbery charge in exchange for his cooperation with prosecutors. He was sentenced to 12 years' probation, starting in 1998.
A Miami-Dade County jury ordered the rental car company to pay Dieperink's family $5.2 million for not telling the couple about the crime in Liberty City.

Instead, a man shoved a handgun through the taxi window and grabbed a GPS system off the dashboard, Officer Jason Lee said. Hernandez sped away and called police after seeing a car chasing him, Lee said.
"One of the females pulled out a box cutter and began cutting the taxi cab driver, and that's what caused him to crash," Officer April Harding said.
Police arrived at the scene as the other car reached the crash site, Lee said. Three occupants from the second car were detained for questioning, he said.
Hector Jasso and Daniel Martinez, both 20, were arrested for investigation of murder because the girls' deaths occurred during the alleged commission of a crime, Lee said. Both were being held without bail. The third occupant of the car was released.
Lee said Jasso was the robbery suspect and boyfriend of one of the girls.

The 34-year-old mother of two grabbed a shotgun that had been pointed at her face early Wednesday, starting a struggle that ended with one intruder killed with his own weapon and another in the hospital.
"I wasn't going to let them get to my babies," she said, recalling the moment when she pushed up the muzzle of the shotgun, pointing it away from her children's rooms.
Although the intruders told her to keep quiet, she screamed for her husband. She told her 12-year-old son, who was awakened by the sound of the shattering glass front door, to get his 5-year-old sister and hide.
"It was like a horror movie," her husband, 32-year-old Keith Hoehn, told the Fort Worth Star-Telegram. "I thought I was a dead man. We're fighting for our lives."
With Kellie Hoehn clinging to the weapon's muzzle, her husband tackled the man who held the shotgun. She knocked the intruder in the head with a jar candle, giving her husband a chance to wrest the shotgun.
By then the tussle had spilled out onto the front lawn. Keith Hoehn shot one of the men who had a pistol, police said. Wounded, that man ran away.
Then the intruder who initially had the shotgun charged Keith Hoehn.
Kellie Hoehn told The Dallas Morning News that she screamed at her husband, "Shoot him, shoot him, shoot him."
Her husband fired the shotgun and the man fell to the ground. Then the shot man lunged a second time.
"Well, I shot him again, and I guess that was it," Keith Hoehn said.
Dakota Scott Benoit, 20, of Richland Hills, was pronounced dead at a hospital. John Garland Pierson, 25, of Haltom City, was in critical condition and in police custody at the hospital.
"I am not happy that someone is dead," Kellie Hoehn said. "But I am glad that my family is alive."
Police said Pierson was shot in the left arm and the bullet pierced his diaphragm and other organs but his condition was improving. He will face charges of burglary of habitation with intent to commit another felony, police said.
Investigators say the couple were just defending their family and probably won't be charged

SANTA FE, N.M. — A man is in a northern New Mexico jail, accused of driving drunk and leading police on a chase that finally ended with him running over himself.
Roy Travis Aguilar, 21, was treated for minor injuries at a Santa Fe hospital and booked into the Sandoval County detention center on charges of aggravated driving while intoxicated, fleeing a police officer, careless driving and two other outstanding traffic warrants.
A tip on a police hot line Sunday afternoon reported a possible drunken driver on a highway.
State Police Officer Grace Romero spotted Aguilar's pickup truck swerving across both lanes of the highway, driving slowly and then fast. He refused to stop.
After narrowly missing other vehicles, police said Aguilar drove through a ditch and a barbed-wire fence before stopping. He tried to put the truck into park, but it ended up in reverse.
Police said Aguilar fell from his open door and both of his legs were run over by the front driver's side tire.

SEDALIA, Mo. — A Sedalia hunter bagged a big buck on the second day of firearms season, but the kill caused him a lot of pain.
Forty-nine-year-old Randy Goodman said he thought two well-placed shots with his .270-caliber rifle had killed the buck on Nov. 19. Goodman said the deer looked dead to him, but seconds later the nine-point, 240-pound animal came to life.
The buck rose up, knocked Goodman down and attacked him with his antlers in what the veteran hunter called "15 seconds of hell." The deer ran a short distance and went down, and died after Goodman fired two more shots.
Soon Goodman started feeling dizzy and noticed his vest was soaked in blood.
So he reached his truck and drove to a hospital, where he received seven staples in his scalp and was treated for a slight concussion and bruises.

Okay, this just barely makes it in. While I don't think he deserved to lose his life over his previous actions, I have to say that I have no sympathy when people who DUI lose their own life. NONE!!! It is better they lose their life then take another's. I chased by foot some b*tch who ran into the back of another car at around 50 MPH and drove off a couple of years ago. He car finally died about half a mile later and she sent three people to the hospital in neck braces and a stretcher. She had no injuries (her SUV was totalled) and when I finally caught up to her, she had no clue what happened.

But acting chief county detective Jim Vito says the State Department used fingerprints to confirm the crash victim was indeed the 52-year-old fugitive.
In July 2005, Komlo failed to show for sentencing on two drunken driving convictions. He had also failed to show for an unrelated hearing two months earlier.
Komlo was also under investigation for fires at home in Pennsylvania and Florida.
Komlo played for the Detroit Lions, Atlanta Falcons and Tampa Bay Buccaneers between 1979 and 1983.

Summit County Sheriff's Sgt. Scott Cottle said witnesses saw Erich Schultz and Stacy DiJulius arguing Saturday night in a parking lot after both had been drinking at a bar in Sagamore Hills, about 20 miles south of Cleveland.
Schultz, 38, tried to drive away in his Jeep, but DiJulius attempted to get into the vehicle as it moved and fell under one of the tires, Cottle said. He added that it appeared Schultz accidentally ran over DiJulius and that he felt so bad about it he then took out a gun and shot himself.
The 39-year-old DiJulius died at a hospital soon after the accident. Schultz was pronounced dead at a hospital Sunday afternoon

An afternoon shootout at a busy Burger King restaurant in Miami left a potential robber dead and the customer who shot him seriously wounded.
The bloody event unfolded about 4 p.m. Tuesday at the restaurant at Northeast 54th Street and Biscayne Boulevard. It was a time, employees said, when it is usually crowded with schoolchildren and people getting out of work early.
The robber entered wearing a ski mask. He approached a clerk, showed his gun and demanded money, said Miami police spokesman Jeff Giordano.
A customer eyed him and the two started arguing. The customer had a concealed-weapons permit and his gun -- and the two exchanged gunfire.
The robber crumpled to the floor and was pronounced dead at the scene.
The customer, with several gunshot wounds, was in serious but stable condition at Jackson Memorial Hospital's Ryder Trauma Center.

It's my understanding that if you fear for your life or the lives of others, you'd be warranted in using your concealed weapon.

Lacking the training and authority of a police officer, a private citizen is going to have a much harder time justifying taking action, especially if anything went wrong, ie a bystander is hit, even if they were hit by the crook. I'm not saying they couldn't protect themselves or others, but if they just started shooting to stop the robbery, they might find themselves charged.

Xaviein Bendross, 28, was one of three men killed in a drive-by shooting Saturday at an intersection in Miami's crime-ridden Liberty City neighborhood, Miami-Dade County police said Monday. A fourth man in their car remains hospitalized in critical condition. No arrests have been made.
Bendross was on probation for his role in the death of 39-year-old Tosca Dieperink at a nearby gas station.
"I think it's ironic - tragedy begets tragedy," said Miami-Dade police Sgt. Anne Bogen, who helped investigate the 1996 case. "It's terrible anytime anyone gets killed. It was tragic for the Dieperink family and I'm sure it's tragic for the Bendross family."
Dieperink was shot in the chest while sitting in a rental car. She and her husband had pulled into the gas station seeking directions to a mall. The slaying rattled Florida's tourism industry, which at the time was still struggling to recover from the slayings of 10 foreigners in the state in 1992 and 1993.
Two young men pleaded guilty to second-degree murder and are still serving decades-long prison sentences. Bendross, then 16, was the driver of their getaway car and pleaded guilty to a robbery charge in exchange for his cooperation with prosecutors. He was sentenced to 12 years' probation, starting in 1998.
A Miami-Dade County jury ordered the rental car company to pay Dieperink's family $5.2 million for not telling the couple about the crime in Liberty City.

Yeah, but I'm not contrasting "bust a cap in his ass" with the much safer approach of "do nothing and let the guy steal $40".
I'm talking about "Yell at the guy with a gun" vs "take out your gun and use it".
I think, in order of ways I'd like to see this handled by a patron of the Burger King:
1) Do nothing. Get a good look at the perpetrator. See if you can't catch a license plate or identifying features after he leaves. Promptly call the police, and write down any details so you can fill out a useful report.
2) Take out your firearm. Disengage the safety and prepare yourself to use the weapon if necessary. Wait until the perpetrator isn't pointing his weapon at anyone, and demand he gets on the floor or you'll shoot him. If necessary, shoot him.
3) Take out your gun and bust a cap in his ass. Let God sort it out.
4) Argue with the guy who's holding a gun, getting into a firefight costing his life and possibly your own.

The September 11 terror attacks were a watershed event in the life of a Canadian journalist named Beverly Giesebrecht.
Soon after Al Qaeda terrorists killed 3,000 people in the U.S., Giesebrecht converted to Islam, adopted a new name — Khadija Abdul Qahaar — and spent the next two years studying the Koran in Egypt.
She created a pro-Jihadi Web site, Jihad Unspun, and she developed a network of contacts, contributors and translators, some of whom introduced her to the Taliban in Pakistan.
She wrote of her motivations online:
"I became obsessed with finding out what was really going on. In the early days of my research, I remember sitting at five in the morning, exhausted, after going from link to link to link to link, staring at the face of Osama bin Laden. This man does not have the face of a cold-blooded killer. This is not a Charles Manson. There has to be something more.
"I made the decision to launch a Web site with the hope of informing the public about some of the things I had come to know and to give voice to the other side of war on 'terrorism.'
"There was no question in my mind, from the first days of my research, that the so-called war on 'terrorism' was a sham. This is not a war on 'terrorism' — this is a war against Muslims and our resources.
"It is my hope that this will inspire others to Islam and to take a stand against this shameful war on 'terrorism.'"
The anti-American Web site provided news articles, first-person commentary and opinion pieces that criticized Canadian support for American foreign policy, and translations of speeches and writings by Usama bin Laden and Taliban leaders, among others. Qahaar quickly established a reputation for being able to connect with militants, and she was even hired to help work in research and production of a documentary called "Dining With Terrorists" that aired on Al Jazeera.
And then last November, the Taliban, the group she had befriended, kidnapped her while she was chasing a story in the Bannu region of northern Pakistan. In a video released after her capture, Qahaar says she's being held by the Taliban, though it's not clear exactly who is holding her. Officials have not provided clarification, saying only that there are many criminal gangs in the region who call themselves the Taliban.
Now, four and a half months later, 11th-hour negotiations continue in efforts to save Qahaar's life and secure her release. Her captors have demanded $375,000 in ransom money by the end of March, and they have threatened to kill her if their demand isn't met.
Exactly what happened in November, and why, remains unclear. That the Taliban has kidnapped one of its own supporters — and one who has given them a media platform — is puzzling to terror experts and Qahaar's former colleagues.
"She is definitely sympathetic to Al Qaeda, to the Taliban, there's no doubt about it — and she believes in jihad," said terror expert Steven Emerson, who has followed Qahaar's Web site. "I think — and this is just based on logic and rationale — it just doesn't make sense that they would threaten to kill her unless they get money, when she's been such use to them spreading their word in the Western world."
Phil Rees, a BBC reporter-turned-documentary filmmaker, met Qahaar in Kuala Lumpur in 2006 and hired her for nine weeks to work on "Dining with Terrorists."
"I hired her for her Taliban contacts. She was a good source for contacts from the jihad side of things. She delivered," Rees said.
After three months in Pakistan and a 10-day shoot in Lebanon, Qahaar told Rees she wanted to move back to Pakistan to pursue her Taliban contacts and the greater story.
"I remember, she told me about how she wanted to live there. Why? Because it's a hot story! It's the absolutely most central story on the global terrorism end," Rees said.
"She was desperate to forge a career as a journalist and she had very exclusive access — I think that's what she saw, that she could cut into mainstream journalism by doing this — and hell, well, if you could get Usama, you've made it for life."
"She was translating the words of Taliban and Al Qaeda — she was my insurance policy," he said. "Why would they kidnap her? I never thought they would kidnap her."
Qahaar returned to Pakistan in August, but by October she had posted a letter on her Web site soliciting donations from her readers to get out of an increasingly dangerous area.
"Pakistan is now erupting into a full-scale war zone," she wrote. "We have been in some very sensitive areas and even Islamabad is now locked down. As foreigners we must leave the country however we do not have the funds to get out.
"As a woman, I have already had a few close calls in the tribal areas as kidnappers and thieves are running loose even in Peshawar but alhamdulilah Allah has helped us.
"This matter is urgent and inshaAllah I can count on our good supporters to help. Again I must apologize for having to make this request but at this time I have no other alternatives. With no family, it is my brothers and sisters that I must turn to for help. Please."
The following month, in November, Qahaar was kidnapped. In series of videos posted on jihadist Web sites since then, she has appeared increasingly desperate and debilitated.
In the most recent video, released to the Miranshah Press Club on March 18, Qahaar says her captors demand ransom payment of 2 million Rupees — about $25,000 — by the end of March. On earlier tapes, she said her captors were demanding $375,000.
"I'm pleading with you, save my life. Spare me," she says. "We have a very short time now, I'll probably be beheaded."
"At this point, you're going to kill a 53-year-old lady who is sympathetic and runs a good Web site? Why would you do that?" Emerson asks. "But you also just don't know what's going on there and it's impossible to tell where the video came from. There are a lot of questions."
Rees dismisses the idea that Qahaar is working with the Taliban and that the kidnapping is a hoax intended to raise money. The videos confirm that Qahaar is in real trouble, he says.
"Did they turn her? I've thought about it, I just don't believe it.
"Listen, I know her. She needs like a million things, stuff for teeth, she's persnickety about everything, she needs vitamins, healthcare ... Who would do that? She wouldn't do that.
"Look at the state she's in. She looks completely awful — this isn't an acting thing. No, I'm sorry. No way. Not for a moment.
"She believed the Taliban were legitimate in resisting armed forces in that country, she believed she could interview these people because she could give them fair hearing and I believe they turned on her," Rees said.
"And after all this, she's depending on the support of the same governments she spoke out against."
Mindful of her captors' deadline, Pakistani and Canadian officials have been meeting and strategizing in Islamabad, while the local government authority has been negotiating with tribal elders who have been meeting with the Taliban.
"Pakistan is very much cognizant of what is going on and they are searching for her, in both North and South Waziristan, and tribal elders are negotiating with the local government authority," a Pakistani official told FOXNews.com.
"These kinds of instances are usually resolved through military and intelligence channels, and that is what is happening."
Lisa Monette, a spokeswoman for the Canadian Department of Foreign Affairs, said, "We are not commenting or releasing any information which would compromise our ongoing efforts or endanger the safety of the individual involved, but we continue to pursue all channels for seeking the release of Ms. Giesebrecht."
"I need somebody to help me," Qaahar pleaded on the most recent video. "My government — the Canadian government, the Pakistan government — I want to go home."

A Minnesota man recruited to join an Al Qaeda-linked terrorist group overseas may have been assassinated in Somalia by the very terrorist group he went there to help.
The Federal Bureau of Investigation has been investigating for several months at least 20 Somali-American men from the Minneapolis area who recently traveled to Somalia to train with the terrorist group al-Shabaab.
One of those men — 17-year-old Burhan Hassan — was killed in Mogadishu on Friday, his uncle, Osman Ahmed, told FOX News.
"Someone who claimed (to be) a member of al-Shabaab called Burhan's mom Friday (afternoon) and said Burhan died Friday morning," Ahmed said. "Burhan's mom got shocked and (threw) the phone when she heard the story."
"Al-Shabaab assassinated Burhan and shot (him in) the head," the individual said, according to Ahmed.
A law enforcement official told FOX News on Sunday that one of the Somali-American men was recently killed in Somalia by artillery fire, but the official declined to release the man's name.
"My sister still is under shock," Ahmed said.
Ahmed added that he and his family last heard from Hassan two weeks ago.
"That time he was sick, and he couldn't talk that much," he said. "He called his family and Burhan's voice was very weak, and then (a friend with him) ... told the family Burhan was sick a while and having malaria."
Hassan was a senior at Roosevelt High School in Minneapolis when he left for Somalia.
"(He) was a brilliant student with straight A's and on top of his class," Ahmed testified at a Senate hearing in March focusing on recruitment efforts by al-Shabaab. "He was an ambitious kid with the hope to go to Harvard University to study medicine or law and become a medical doctor or a lawyer."
Ahmed accuses a local mosque of helping al-Shabaab recruit his nephew and others in the Minneapolis area.
"Like his peers, Burhan Hassan was never interested in Somali politics, or understood Somali clan issues," Ahmed said during testimony. "These kids have no perception of Somalia except the one that was formed in their mind by their teachers at (a local mosque). We believe that these children did not travel to Somalia by themselves. There must be others who made them understand that going to Somalia and participating the fighting is the right thing to do."
Hassan is the second known American to die alongside al-Shabaab, which has been warring with the moderate Somali government since 2006.
In October 2008, 27-year-old college student Shirwa Ahmed of Minneapolis became “the first known American suicide bomber” when he blew himself up in Somalia, killing dozens, according to the FBI.
A source familiar with the FBI investigation told FOX News in March that "several" of the men who went to Somalia had returned to the United States, while others "are still there (in Somalia)."

What started as a homeless man's beating on Miami Beach on Wednesday morning ended with an injured drifter, two teenage boys in jail and a man hospitalized with a stab wound, according to police.
Felix Garcia, a 40-year-old homeless man, was attacked by three young men early Wednesday near 72nd Street and Collins Avenue, according to Miami Beach police.
But as they doused him with pepper spray and punched him, Garcia fought back -- with a knife, police said. Garcia stabbed the oldest of his attackers, 21-year-old Ronnie Rodriguez, who was taken by paramedics to Jackson Memorial Hospital's Ryder Trauma Center.
Garcia's two other alleged attackers, both teenage boys, were later arrested. Police said they will not charge Garcia for stabbing his attacker because he acted in self-defense.
Garcia's condition was not immediately clear. Police spokeswoman Deborah Doty said Rodriguez was in stable condition.
"He's going to be fine," she noted.

A man died when he was impaled on a large shard of glass after throwing a woman through the window of a shop in the West End of London early Tuesday morning.
The 30-year-old victim was seen arguing with the woman in the Regent Street area of London’s West End shortly after 2 a.m.
Witnesses told police he hurled the woman against the window of a branch of Banana Republic up to three times. After several blows, the glass shattered and the couple fell through, leaving the man fatally wounded.
Members of the public flagged down a police patrol, which went to the shop at the junction of Regent Street and Great Marlborough Street.
Paramedics also attended but the man was pronounced dead at the scene. A post-mortem examination will take place Tuesday.
The woman, also 30, was taken to hospital for treatment to multiple cuts, none of which was thought to be life-threatening.
A Metropolitan Police spokesman said: “Shortly before 2:15 a.m., officers on patrol were informed by a member of the public of an altercation in Great Marlborough Street.
“When officers arrived at Great Marlborough Street, they found a male, believed to have gone through the window of a shop. A woman was also found at the scene, suffering cuts."

Farris, a former paramedic at the station, had been trying to crawl under the door after the ambulance left to respond to a nonexistent traffic accident she'd called in a few minutes earlier.
Caldwell Police Chief Chris Allgood says it may never be known why Farris was trying to gain access to the station
But according to a police report obtained by KBCI-TV, her sister told investigators that Farris may have been going after prescription medication stored in the station.

I respect your opinion, but you misunderstand what I advocate. In summary, I argued that civilians are held to higher standards. I also argued that civilians and officers should be held to the same standards. Ergo, officers should be held to higher standards.

Brian Street, who's serving 30 years for repeatedly raping his stepdaughter, has filed a federal lawsuit alleging that prison officials deliberately put an inmate in his cell to rape him. Street claims he was raped 10 times and claims the assaults have left him "scared to death," the Omaha World-Herald reports.
The stepdaughter, meanwhile, is doing 45 years for burning down their house in a botched attempt to kill Street in 2005. Instead, she killed her sister and a little boy who lived with the family. The story quotes a Boys Town counselor who works with her and who says Street can't be trusted.
Peter noted that Street tried to manipulate his stepdaughter, even at his sentencing. As he was being led away in handcuffs, Street, then 39, called out to the teen: “Just look at me and tell me you never loved me. Then I'll leave you alone.”

A suicide bomber wearing a vest laden with explosives was killed by locals Thursday in eastern Afghanistan before he was able to detonate, police said.
The incident occurred in the Muqur district of Afghanistan's Ghazni province, according to Kheyal Mohammad Sherzai, a police chief in the province.
The suicide attacker was from Pakistan's Warizistan area, authorities said.
The people who intervened in the incident pelted the man with stones and slashed him with knives and were able to kill the man and give the suicide vest to police.

A black man convicted in the death of a white Jewish scholar during race riots in the 1990's has been stabbed in the head with an ice pick in a possible road rage attack, police say.
Lemrick Nelson was found outside his car on a Manhattan street early Sunday and was taken to a hospital, where he was listed in stable condition. Police had made no arrests.
Nelson was a central figure in the rioting that tore through Brooklyn's Crown Heights neighborhood in 1991, stoked by tensions between the Jewish and black communities living side by side.
The riots began Aug. 19 of that year after a 7-year-old black boy, Gavin Cato, was struck and killed by a driver belonging to the ultra-Orthodox Lubavitch community. Three hours later, a gang of angry blacks shouting "Get the Jew!" descended on and fatally stabbed Yankel Rosenbaum, who was visiting from Australia. For more than two days, blacks looted stores, burned police cars and hurled bottles in the neighborhood.
Nelson, who was 16 at the time, was acquitted of state murder charges but was convicted of federal civil rights charges after Rosenbaum's death. An appeals court later overturned the federal conviction, saying the judge had tampered with the racial makeup of the jury.
In 2003, a new jury found Nelson guilty of violating Rosenbaum's civil rights. Nelson was sentenced to 10 years in prison but was released within a year because of time he had already served.
Nelson's defense lawyers didn't deny he had stabbed Rosenbaum, who was 29. Instead, they contended the slaying had nothing to do with the fact Rosenbaum was Jewish — a key element needed for a conviction.
Nelson, now 35, was on probation for three years. He has been living in New Jersey.

Cockfighting is a sport, illegal in the United States, in which specially bred roosters are put into a ring and encouraged to fight until one is incapacitated or killed.
According to Kern County Superior Court records, Ochoa paid $370 in fines last year after pleading no contest to one count of owning or training an animal for fighting, according to the newspaper.
Attending or organizing a cockfight, or training an animal to participate in one, are all misdemeanors under California law, although a second offense is a felony.

See, a lot of suicide bombers—in Russia and elsewhere—trigger their bombs via text messages to cell phones wired to the explosives. The thing is, though, you have to keep your phone off until the right moment. Because if you get an errant text ("wat r u doin"), you will blow up.
According to The Telegraph, Russian authorities believe a would-be suicide bomber did not follow this advice so well:
Security sources believe a spam message from her mobile phone operator wishing her a happy new year received just hours before the planned attack triggered her suicide belt, killing her but nobody else.

Debra Oberlin, a former president of a defunct chapter of Mothers Against Drunk Driving, was arrested recently by the Gainesville, Fla. police - for drunk driving, according to the Gainesville Sun.
Maybe that's why she's a "former" president?
Oberlin, who's 48, was arrested after she had difficulty on a field sobriety test, according to the Sun. She registered a .234 and .239 on breath alcohol tests, nearly three times Florida's legal limit for driving.
On Feb. 18 at 1:10 a.m., an officer spotted Oberlin driving erratically, swerving and crossing lanes, an arrest report states. She was pulled over, and the officer reported that Oberlin smelled of alcohol and had watery, bloodshot and dilated eyes. The report also states that Oberlin told the officer she had four beers, according to the newspaper.
The Sun says Gainesville's chapter of Mothers Against Drunk Driving existed for several years in the 1990s before closing in 1996 because of a lack of financial support. Oberlin was the chapter president for three years.
Maybe that's why it's defunct?

The woman, a married mother of three, was attacked Saturday night while she was sleeping in her shanty in Jhalakathi district, some 120 miles south of Dhaka, officers said.
"As he tried to rape her, the lady cut his penis off with a knife. She then wrapped up the penis in a piece of polythene and brought it to the Jhalakathi police station as evidence of the crime," police chief Abul Khaer said.
The woman filed a case accusing the man -- who is also 40 and a married father of five -- of attempted rape, saying that he harassed her for six months.
The severed penis was kept at the police station, and the rape suspect was undergoing treatment in the hospital.
"We shall arrest him once his condition gets better," Khaer added.

REFUGIO, Texas (AP) — Investigators said a man has died while in the act of raping an elderly South Texas woman.
The Refugio County Sheriff's Office identified the man as 53-year-old Isabel Chavelo Gutierrez. Sheriff's Sgt. Gary Wright said the incident happened June 2 after he rode two miles by bicycle from his home to that of his 77-year-old victim in the tiny coastal community of Tivoli.
Wright said the 5'-7", 230-to-250 pound man sneaked into the woman's house and raped her at knifepoint.
During the assault, he said he wasn't feeling well, rolled over, and died.
Gutierrez' body was sent to the Nueces County medical examiner in Corpus Christi for autopsy.
Gutierrez was a registered sexual offender on parole from a sentence for aggravated sexual assault and indecency with a child.
