View Full Version : [Resolved] Filing Dispute with Paypal For 3bay Purchase

All of my 3bay purchases have gone rather smooth until right about now. I purchased a $2 card slot POTS fan controller. The seller is overseas, though most of my overseas purchases have only taken 2-3 weeks which is very reasonable. so now it is going on 5 weeks (30 days) for this purchase. per paypal you have 45 days to file a dispute. so im planning to wait until the end of this month before doing anything. my first plan of action is to mail the seller and bring the matter to their attention and request a refund. ill give them 3 business days to respond. if they dont then i will file the actual dispute through paypal and try to get the sellers attention that way. ill wait 5 business days for a response. if no response then i will escalate the matter to paypal. the seller in the last 30 days has sold over 6k items with 100+ neg and 100+ neutral (resolved). in the last 6 mos. they have had 700 neg and about 300 resolved.

so is this the right way to go about things?

Be aware that if you do decide to email the guy, it can take a while for him to respond, due to time zone differences. Three business days sounds reasonable, but don't be surprised if it takes the whole 3 days. Make sure to be polite, but do mention that you will file the dispute if you don't hear from him.

700 negatives out of 11k sales is over 5% - not a good failure rate, IMO. Given that almost half were resolved, though, going the email route first could be useful.

yup, my letter to him would be polite and say that if i dont get a response then i will file a pp dispute.

Bear in mind that if you get a response from the seller and they agree to ship another piece, you may have to wait another 2-3 weeks for this second piece to arrive and if it doesn't arrive in a timely fashion, you'll be past the 45 day return policy of Paypal.

This is a $2 item and I assume you mean e-mail and not mail, correct? If so, I'd just e-mail them through the eBay system and tell them you still haven't received the item and that its been XX days. If you don't hear back from them within a day or two or you don't like their response, file a claim. If they respond, tell them you'd like a full refund and you'll reorder it (from someone else) to start the 45 day clock again.

I would file a dispute now, you have waited a reasonable time and when you do file a dispute you get the sellers attention fast.

okay, ill do that now.

that was fairly easy, so lets see if the seller responds in 3 business day, which will be this time next tuesday.

one reason why i decided to go ahead and contact the seller through pp dispute is some of his negative feedback says he wasnt responding to emails.

Be cautious with your wording, you are prohibited from sending threatening emails and that is right on the borderline...a true statement but just be on the safe side. I would just send an email saying, "I won auction #12345678 and noticed that it has been ## weeks and it has not yet arrived. Could you please verify that the product has actually been sent or has there been another issue which caused a shipping delay. I know I have ## amount of days to seek recourse from Paypal and wanted to make sure that I try to resolve it with you at the lowest level prior to contacting Paypal for assistance.

Make sure you send all emails/correspondence through Ebay, this way Paypal will have immediate access to your attempt to contact the seller and this will speed up your claim.

I have been ripped off on two different transactions with overseas sellers, that is why I will pay the extra couple bucks and only purchase from U.S. Sellers.

yes 'if you dont do this, i will do that' is a borderline threat, but thats whatt it takes to get action out of an overseas seller that numerous other buyers are complaining about.

Have you tried to contact the seller through Ebay message, or have you just waited all this time an not made any contact? Send the guy a message and tell him you haven't rec'd your item. You probably wouldn't be surprised that he probably waits a lot of his buyers out and doesn't ship -- gets their money free and clear because they don't ever make a big deal out of it. Contact him and if you haven't a response in 3 business days, file a dispute. It's probably what he's waiting for. Ebay likes it when you have confirmation that you attempted to contact -- it goes in your favor.

Good news... i just received an email at 4 am this morning from PP that said the dispute was closed. "hum" so i looked in my PP acct and sure enough it was refunded.
