Hey guys, I have a 2008 sedan I got preowned last year with warranty left on it until December. I am going back to the dealership for the third time because of the same exact problem. Some people mentioned to me something about the lemon law and being able to get the dealership to buy back the car or something along those lines. The issue I'm continuing to have problems with is that the gas tank fills only halfway. I bring it in, they do something, I can fill up once or twice to full, then it happens again.

Any ideas? I would LOVE to be able to sell the car back to them.

I think if you buy it from the dealer as a new car, not sure if being the 2nd or 3rd, etc owner entitles you to the lemon clause...you are still covered for any recalls on the car...but I think the lemon applies to the 1st owner only.

I agree with DC. Lemon laws apply to new car purchases. I don't believe it applies to preowned/used cars. The only thing you can get is a warranty with a preowned/used car purchase. Depending on state laws, some states may have pro-consumer laws regarding used car purchases with dealerships.

Yep, new cars only. And I think the three issues with the same problem has to be within the first year, if I recall correctly...

I think you need to figure out what the problem is (according to the dealership), and call around to at least a half a dozen mechanics and ask them about it.

Then get it repaired by someone who is competent and file a claim against the dealer for reimbursement of that bill.

He says warranty is left on it until December, so I'll assume there's no bill from the dealer. And if they're giving him a loaner car, there probably much that can be done except make sure they fix it properly before the warranty is out.

Yeah I am suggesting that he get the repairs done from another mechanic and have the dealer who is honoring the warranty pick up that bill. Since it seems that the dealer cannot fix the problem anyway.

Or I guess the OP could demand that the whole fuel system be replaced or something :unsure:

It's probably just the tank and/or filler neck.

Or....


OP, do you fill up at different stations? Or do you use the same station, and even more specifically, the same pump at each fill up? If so, you could try a different station/pump and see what that does.

If you have the bad habit of getting that tank as full as it can possibly go, you might have a full vent system from previous overfills. There is a charcoal catch canister that picks up over-fueling ... this is the vent I mean. If this is the case you could continue to half-fill for a few tanks til the vent evaporates on it's own or change the canister again.

I do not see where the OP indicated that it's fuel related problem (or exactly what the problem is???).

I'm guessing an EVAP CEL code based solely on responses though.

Hahaha yeah right...I wish.

I have been using different gas stations. They already changed the filler neck and fuel sensors. Next they said there are a few other things that it can be that they may change...

Is this a Subaru? They are famous for that. If so I can go research this as I do think there is a fix for that.

I was serious. I've gotten one for free due to a recurring problem. They cost the dealership almost nothing.

The Lemow Law doesn't apply afaik, but you can certainly contact consumer affairs, the BBB, or even hit small claims if the issue is expensive enough to warrant that.

I've owned 5 Subarus (2 currently), and none of them have had that issue. I've never even heard of it being a common problem on them.

sounds like something is cloggin the line? Gas tanks can be pretty dark so be sure to strike a match before lookin down it
