If this did come down to a decision by the court the judge in the case would have to consider all the facts of the case. Under what category was the auction listed? What was the description? And so on. I cannot view these auctions, but if the listing individual describes the product instead of the box things would not go easy in court. And I really think that a judge would look for damages as they tend to dislike assholes.
Parts of the above are also violations of eBay policy (you cannot describe any item other than what is offered, wrong category, etc).
It it ever came to it the wronged party could try Judge Judy. She did not take kindly to this type of swindle on a prior occasion.

A friend of mine pointed out on the 2nd one that the douchebag listed the item as New in the full description:
New: A brand-new, unused, unopened, undamaged item in its original packaging
Nice to know the the douchebag (retard tax or no) will have likely screwed himself on this one. The buyer would have at least some recourse on this one I would think.

|JerodKing||While yes people should read, I think this also preys on older people that aren't as technology savvy as we are. I know my dad used to call my NES the Nintendo box. And while the second ad does say that it does not include the system (which the first one doesn't), it also lists all the specs of the PS3 before it says that. People that pull these stunts make me sick.|

Doesn't ebay get rid of those types of listings once they are reported?
I assume they do considering they want ebay to be a safe place for everyone to shop.
