This is incorrect. AT&T has settled and is agreeing to payout $18 million -- $16 million in cash and $2 million in non-cash benefits. LINK1 [msn.com] LINK2 [nj.com]

It's important to note that even those that have NOT been charged ETF also qualify.

As long as you had a fix rate ETF in your contract during the period, even if you never left your contract or left after the ETF period, you may qualify for compensation.

Final note - if you do nothing you forfeit your rights to sue on this issue. The timer period to exclude yourself from the class expired on Mar. 23, so the only thing left is to submit a claim if you qualify.
