i noticed that the warranty is

Warranty Length: 90 days

unlike Apple's policy of 1 year for the ipod touch.

"The third generation iPod Touch with the new iPhone OS 3.1 was announced and subsequently released on September 9, 2009. This is from an Amazon review> Can anyone confirm this:
"The 32 and 64 gig models really are a third generation, they run faster, include a headphone with remote and microphone, and allow voice control of the device. Yeah i own the 3rd Gen iPod Touch and can confirm that the Amazon review is true 100 percent.

You had your answer in the Wikipedia statement. (see bold sentence). The new firmware only cost $4.99 on iTunes so why pay extra for the "3rd Gen" 8GB? Buy a 2nd Gen for cheap and update the firmware.
