Yes it's legal, and it's happening more and more in stores. Kmart in my area (Southern California) does the exact same thing, even when you have the receipt and you paid with cash.

I would imagine that they attempt to make scans of it, but last time I tried that it didn't let the scanner scan it (it turned glossy from the bright scanner light)
