I was not charged tax with this deal. I was charged tax when I ordered from the Apple store (yes I bought 2 of them). I live in Seattle, WA.
According to the info on Ebay these come with a brand new battery and the previous OS (that would be iOS 5 or maybe 5.1 according to the guy who posted above). They basically look and work brand new with quality inspection done by Apple.

Not that that's a huge deal considering the product itself should be fine but who want's to get a gift that says used and fixed basically.

New outer case and new battery in the ipod so essentially everything is new except the electronics inside the IPOD!! If it fails within a year than you can still get another one!!! Good deal!
