***Update*** They are selling this on Ebay: http://stores.ebay.com/Refurbishe...34.c0.m322 I was not charged tax with this deal. I was charged tax when I ordered from the Apple store (yes I bought 2 of them). I live in Seattle, WA. According to the info on Ebay these come with a brand new battery and the previous OS (that would be iOS 5 or maybe 5.1 according to the guy who posted above). They basically look and work brand new with quality inspection done by Apple.

Anyways if you're looking for this for a teen..I'd buy it versus the 5th gen. because if they break it you won't cry as hard

The camera on the 5th gen is as good as the iPhone 4S and maybe even a bit better because I think it uses a better algorithm for low light scenarios. The faster processor opens up new doors for game play or apps like iMovie where you can make trailers (you can't make trailers in the 4th gen iPod Touch).
You can almost consider ditching your point and shoot camera altogether and just use the 5th gen iPod touch, it's that good. And the little apps you have can make your pictures shine like Instagram and collage makers.
A used smartphone can do everything your smartphone can do but make calls and I bet you can make call on skype, maybe google voice. It just works for them on wifi. I know they can text if they have a wifi connection. And the GPS units still work! You can actually use the GPS without cell service. Think of all your smartphone can do, your kid can do almost all those things on wifi.
While the SD card slot and removeable battery are great features to have, there are just too many great apps that arent available for Android. I only listed a few, but I have a whole list of them actually. This caveat is much easier to accept when you have never had a taste of the app store. You can't miss what you've never had.
While GPS positioning does not require an internet connection, any application that utilizes the GPS, wether it be navigation, maps, or something like Yelp, will require an internet connection. Maps and other data are pulled from the internet, and are not saved on your phone.
An iPod Touch, or your suggestion, a non activated Android smartphone is little more than a device to run apps. So for me, i'd rather stick with the platform that has better content to offer. I could name a dozen apps that I was disappointed to find Google Play store not have. And when I switched back to iOS, I couldnt think of any must have Android apps that weren't available for iOS.
but i'm tired of it. it really is a bit too slow (i also use an ipad 2 all the time which has the same chip as the ipod touch 5th gen) and it can't run newer awesome games like horn. and now it's only going to get worse in the future.
this is a good price because it has a good resale value, but for reference i am personally selling my ipod touch 4th gen 32gb to pay for 2/3's the cost of a 5th gen because that processor and extra inch are so, so worth it, to me. a heavy ipod touch user.

But yeah, the 5th gen is definitely worth upgrading to. For me, a big part of it is the camera. Having the higher resolution, better lens, panorama, and flash, really makes it a worthy point n shoot camera that can handle regular everyday stuff. And the RAM upgrade improves performance with pretty much everything.

most kids pick these things up and learn to use them very quickly. sometimes the apps are a waste of time and sometimes they are amazingly good at teaching skills and information. how you sort through all the options will ultimately determine if it is a good purchase or a bad one.

I feel like your comment that the camera sucks but you have a real camera is a poor excuse. If you're going to put a camera on something, either make it good enough to use or leave it out. To me it's like saying "Yeah I can barely hear my car radio it really sucks, but I have a boom box I just hook it up in there"
