I was not charged tax with this deal. I was charged tax when I ordered from the Apple store (yes I bought 2 of them). I live in Seattle, WA.
According to the info on Ebay these come with a brand new battery and the previous OS (that would be iOS 5 or maybe 5.1 according to the guy who posted above). They basically look and work brand new with quality inspection done by Apple.

Alrighty, called my hubby. Snagged a 32 GB black one for my 10 y.o. daughter! She is going to be so excited Christmas morning! We try not to spend more than $150 per child at Xmas as we don't have a big income but I figured it's worth it to have the extra memory on it. Now I can ask the relatives to get her itunes g.c. for xmas.

not necessarily but as many manufacturers have learned a hard lesson on, once the consumer invests in a bunch of apps etc. it is really hard to get them to switch. apple does have the best apps in my opinion but I know there are plenty of advantages to android too. if you want a 7" tablet then the nexus is a great value

My 13 year old daughter loves her Ipod Touch. She uses it all the time and it has managed to keep us from having to go the "cell phone" route so far. All her friends have phones so the "peer pressure" has been great but the Touch gives her so many great things to use that she is happy at the moment.

She has had a 4th gen since it was released.
