I was not charged tax with this deal. I was charged tax when I ordered from the Apple store (yes I bought 2 of them). I live in Seattle, WA.
According to the info on Ebay these come with a brand new battery and the previous OS (that would be iOS 5 or maybe 5.1 according to the guy who posted above). They basically look and work brand new with quality inspection done by Apple.

Excellent for the Tween set since they can "Facetime" . I picked a 32G up on Ebay for $165, but the warranty was only for 2 months, so to me, this is a good deal.
