There's a reason these phones are constantly getting discounted and shunted to VM and similar pre-paid carriers. It's a lot like the dying days of HD-DVD. You can get yourself some cheap equipment but you know going in eventually it won't be supported .
Not to be a total debbie-downer, this is a solid phone, especially for the price. If you live in an area with good WiMAX coverage, you could do a lot worse than to get this phone. As the first link mentions though, LTE is just faster and better in general.
If you live in an area without WiMAX coverage though, I wouldn't get this phone expecting to be covered soon. WiMAX is more or less done expanding and it's likely LTE will be your ticket.

So I would say the best (legit) Virgin Mobile phone is the Galaxy SII.

1. is there a contract or is it $140, done deal?
2. I assume it has wifi, can you use that instead of a data plan or is that somehow tracked as minutes?
3. basically can you treat it like a $140 device which you can use on wifi but also have minute time to use as a phone as well?
What really is prompting this is my wife is ready to upgrade to an iPhone5, and she was going to give her iPhone 4 to our daughter who right now has a simple phone for emergencies via an additional line added onto our Verizon Family plan ($10 a month extra). however they won't allow us to activate the iPhone 4 for our daughter withough commiting to a data plan ($30), which we don't want to do and would prefer to not do that, but still have her be able to do wifi for downloads and stuff. So I'm either looking for a way around that or a different possible solution such as a deal like this.

I should add that the amount of savings you'd get is minimal, I would probably just opt to pay VZW their money and avoid the headache of managing another line, etc to save ~$5/month. Your daughter would probably like the iPhone better, especially since her mom has one and whatnot.

2. You can use WiFi, and probably want to if you have coverage. Otherwise the data is unlimited, but likely slow but ok for the price
3.for the $35 a month you get data and 100 nim. You can get a VOIP app like GrooveIP to do calls in a pinch if you are out of minutes or close to.. depends on your data connections. Was hit or miss for me on OptimusV in Seattle..

My coverage here was better than T-Mo in out lying areas, but speeds were much lower.
GoMartMobile is 2G data. For $45, you still only get 3G speeds:
Up to 5GB of High-Speed web (5GB at 3G speeds, then 2G speeds for the rest of the cycle).
If you are grandfathered in with VM, you may be on the $25 (300 minutes) or $40 (1200 minutes) plan which still an outstanding value. Just keep in mind, if you go with a recent smart phone, you will lose your grandfathered rate. IIRC, the Triumph is the best phone on the grandfathered plans.

I have this phone and its great. WiMax works well went its there but coverage is thin.
