The general consensus on underwear/hybrid sizing is to add at least 2-4 inches. And it is even more true at this larger size given it includes some thigh length--unless you are thin legged even at 40" waist.
Also consider usage: if you are wearing if for sport and need the compression effect on the legs and tight hugging of you know whats for less bouncing while exercising, then stick closer to the recommendations. But if its for leisure wear, then I hope you are not hugging the jewels too tight. These run hotter on the jewels, and if you are bound too tight the effect on them is greater than wearing tighty whities

These are by far, the best underwear I've had. I used to wear Jockey boxer briefs but am ready to throw out perfectly good underwear because these are SO much better. They fit awesome and do not constrict at all.
I wear 33,34 waist pants and the large fit perfectly.
